Town Council Resolution 18 2017TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION No. 18 SERIES OF 2017 A RESOLUTION ACTING ON FINAL SITE PLAN AND ELEMENTS SUBMISSION BY THE SNOWMASS-WILDCAT FIRE PROTECTION DISTRICT REGARDING: 1) A PROPOSAL TO REDEVELOP THE EXISTING FIRE STATION SITE AT 5275 OWL CREEK ROAD (SNOWMASS WILDCAT FIRE PROTECTION DISTRICT GOVERNMENTAL SPA, FILING NO. 1 AND PARCEL 8, SNOWMASS CLUB PUD), AND 2) TO CREATE AN INTERIM FACILITY LOCATION AT THE ENTRYWAY SITE ON THE RODEO GROUNDS PARCEL PARKING AREA AT 2735 BRUSH CREEK ROAD (LOT 5, ENTRYWAY MASTER SUBDIVISION PLAT) WHILE THE NEW FIRE STATION FACILITIES ARE UNDER CONSTRUCTION. WHEREAS, an Intergovernmental Agreement (IGA) was authorized between the Town of Snowmass Village and the Snowmass-Wildcat Fire Protection District ("SWFPD" or "Applicant") at a Town Council meeting on June 6, 2016 via action on Resolution No. 24, Series of 2016, to detail the submission requirements for a redevelopment proposal for the fire station site, the review process, public notification, and the scheduling before the Town decision makers; and WHEREAS, SWFPD's proposed improvements were authorized by district voters on November 8, 2016 who approved taxing and bonding as the funding mechanisms to replace the existing firehouse with a new, up- to-date facility; and WHEREAS, on November 30, 2016, the Applicant submitted a Conceptual review packet involving a redevelopment project located at the existing fire station site at 5275 Owl Creek Road, Snowmass Village, Colorado, together with a preferred interim site location to house a temporary structure of 4,200 square feet and modular for all District apparatus and personnel, together with two modulars that will serve as sleeping/living quarters and one smaller modular for an office at the Rodeo Grounds parcel near the northwest corner of the entryway roundabout for the District's interim site operations site for approximately 1.5 years while the redevelopment project would be under construction during that same time period; WHEREAS, on December 19, 2016, pursuant to the IGA, a joint meeting of the Town Council and Planning Commission was held to review the SWFPD's Conceptual submission packet and to garner input TC Resolution 18 2017 Page 2 of 8 from the decision makers and the general public during the scheduled and noticed public hearing; and WHEREAS, on January 13, 2017, and pursuant to the IGA, the Applicant submitted a final Site Plan and Elements submission package for the proposed redevelopment of the fire station site containing 1.2 acres or 52,272 square feet for a new firehouse of approximately 34,000 square feet, including about 17,100 square feet on the lower level and 16,900 square feet on the main street level, together with the interim facilities site at the Rodeo Grounds entry area off of the Entryway roundabout area for operations while the new fire station is being constructed; and WHEREAS, following a completion review, the SWFPD's final Site Plan and Elements Submission packet was referred for evaluation to affected Town Departments and outside referral agencies on January 19, 2017; WHEREAS, a public hearing notice and display ad were printed in the Snowmass Sun on January 25, 2017 for the scheduled Planning Commission meeting on February 15, 2017; and WHEREAS, during the Planning Commission meeting on February 15, 2017, the Applicant presented modifications to the Site Plan and Elements Submission package to reorient the building location, create a larger gap from the northwest property corner, off -set and recess the westerly portion of the front fagade and reduce the floor area by approximately 2,500 square feet; and WHEREAS, on February 15, 2017, the Planning Commission heard a presentation of the development proposal as revised by the Applicant, reviewed the submittal package as modified, the staff report and recommendations, heard testimony and provided comments and recommendations to the Town Staff and to the Town Council by a report via execution of Resolution No. 2, Series of 2017; and WHEREAS, a public hearing notice and display ad were printed in the Snowmass Sun on February 15, 2017 for the scheduled Town Council meeting on March 6, 2017; and WHEREAS, on March 6, 2017, the Town Council heard a presentation of the development proposal by the Applicant, as also modified by the Applicant during the Planning Commission meeting on February 15, 2017, reviewed the submittal package including plan revisions, the staff report and recommendations, heard testimony and provided recommended conditions to the SWFPD via this Resolution; and TC Resolution 18 2017 Page 3of8 WHEREAS, the application was processed, reviewed and commented on in accordance or consistent with the Colorado Revised Statutes Section 22-32-124 and the IGA. Section One. Findings. The Town Council finds that: (1) The application sufficiently incorporates the submission items outlined in the IGA for review and consideration purposes. (2) Meeting schedule notices and display ads were provided for the general public, and the proposed plans were posted on the Town's web page for public viewing, including the revisions made by the Applicant as presented to the Planning Commission on February 15, 2017. (3) Development of the proposed SWFPD's interim facilities on the Rodeo parcel and within the municipal code's 25 foot setback from the pending wetlands delineation area is acceptable for a two year period. Section Two: Comments, Concerns and Recommendations. The Town Council offers the following comments, concerns or recommendations for the SWFPD to incorporate into the construction plans at the time of building permit application: REDEVELOPMENT SITE: (1) License Agreement - The applicant should obtain a License Agreement from the Town to permit the certain permanent features of the redevelopment proposal, or any other improvements such as monument signs, retaining walls and landscaping, to extend into the Owl Creek Road right-of-way prior to issuance of a Building Permit. (2) Sight Distance - The Applicant should coordinate an adequate sight - distance triangle off of Owl Creek Road at the project entry and exit points relative to signs, retaining walls, landscaping and similar features to the satisfaction of the Town's Public Works Department prior to issuance of a Building Permit. (3) Authorization / Consent Letters - The Fire District should coordinate with adjacent owners to ensure shared improvements are consistent with past approvals (parking, driveways, drainage, landscaping) on neighboring properties and obtain signed, written consent letters or enter into a Memorandum of Understanding, TC Resolution 18 2017 Page 4of8 specifically related to the proposed off-site improvements, prior to issuance of a building permit for construction purposes. (4) Cooperative Maintenance Agreement — A draft private cooperative maintenance agreement or Memorandum of Understanding should be coordinated among the campus owners to address access, snow removal and storage, storm drainage, and trash removal functions for submittal to the Town for review prior to issuance of a building permit. An executed version of the agreement should be completed prior to the issuance of a Certificate of Occupancy. (5) Community gardens - The Applicant should continue to coordinate with the Town, including infrastructure / re -grading / top soil assistance, in relocating the community gardens (planned near the Little Red School House on the east side of the Kathy Robinson park beyond the existing playground area). (6) Transit pull off and bus shelter - The SWFPD should continue to work with the Town to install the transit pull off and bus shelter, since it would benefit the personnel and the employee housing units in the new fire station. The proposal to relocate and widen the access road taking into account the options for Owl Creek Road together with a proposed bus stop location (in the Chapel approval) should be considered. (7) Possible future parking deck - Any future planned upper parking deck should be reviewed by the Town prior to permit issuance. It should also be designed with exterior finishes to match those shown on the new fire station and be provided with vertical pedestrian circulation. (8) Firehouse — Additional stone cladding as a wainscot treatment on the west elevation and more vertical application to the training tower at the main driveway entrance would be beneficial to improve the aesthetic appearance of the building for the community. Exterior finish colors should relate to surrounding conditions. (9) Landscape Plan — As an investment to the site and the community, the proposed 10 coniferous trees (both on and off site) should be installed half and half at minimum 6-8 feet and 8-10 feet in heights at installation. The 60 new deciduous trees (both on and off site) should be installed at minimum 2-3 inches in caliper size. Shrubs should be installed at minimum 5 gallon size. No existing trees should be removed within the Owl Creek Road public right-of-way, for aesthetic reasons, except as might be needed for excavation or TC Resolution 18 2017 Page 5 of 8 improved sight distance / safety purposes and with the approval of Town staff. (10) Private access easement area - If the 60 -foot wide access easement is planned to be preserved, then new proposed tree installations should be limited to the perimeter of this area to avoid potential access provision problems in the future. (11) Signs — The proposed joint identification ground sign at the northwest corner of the driveway entrance on Owl Creek Road sits on adjacent property and should be relocated out of the public right- of-way area and set back a minimum of 10 feet to allow for snow storage and adequate sight distance. It should follow the municipal code's sign parameters and designed as a monument style sign with base materials matching the stone cladding on the building to present a high-quality image. Any illumination proposed should not be back -lit but instead use an indirect light source. A sign permit application should be submitted for review and consideration by the Community Development Director prior to installation. (12) Solid Waste Disposal Plan - The dumpster and recycling enclosure should be designed with exterior cladding materials to match the main firehouse and be relocated for easier access by trash trucks. The SWFPD dumpsters must be wildlife resistant and must be kept closed and secure when refuse is not being deposited. (13) Water Supply and Sewage Disposal -The Fire District should follow the requirements of the SWSD conditional "Will -Serve" letter including completion of a line extension agreement. (14) Grading and Drainage Plans — SWFPD should follow the recommendations in the Subsoil report and collectively address the storm water management needs for both the fire station site and the off-site conditions. (15) Geologic Report - The Applicant should follow the recommendations for site excavation and regrading, the footing and foundation installations, and the surface drainage improvements pursuant to the Subsoil report, including that underdrains should be provided to prevent hydrostatic pressure buildup behind the foundation wall beside basement and crawlspace areas and behind retaining walls. (16) Construction Management Plan - The job trailer should be shifted onto the fire station property to allow some sight distance TC Resolution 18 2017 Page 6of8 clearance, unless a Right -of -Way Permit is approved by the Town for features within the public right-of-way, including installation of necessary utilities following review of the construction plans. Construction way -finding signs, however, should not be placed within the asphalt portion of Owl Creek Road. (17) Remaining Review Comments - The Applicant should respond to any remaining outstanding evaluation comments from the Town with the submittal of the building permit application and during the review of the construction plans prior to issuance of a building permit. INTERIM SITE: (1) Development Plan - Access and maneuverability on the Rodeo parcel should be managed to maximize parking and movement among all the users (the District, Rodeo operation during the summer, and the winter parking for skiing), also pursuant to a Memorandum of Understanding between the TOSV and the SWFPD. Any disturbance to the driveway access and project area as a result of construction activities or onsite operations should be addressed or mitigated by the Applicant. (2) Architectural Elevations — A tan color is recommended for the interim facilities per the Applicant's material color samples board, as is also the recommended preferred choice by a majority of the Planning Commission members. (3) Solid Waste Disposal Plan — The SWFPD dumpsters must be wildlife resistant and must be kept closed and secure when refuse is not being deposited. (4) Water Supply and Sewaqe Disposal — The SWFPD should follow the requirements of the SWSD conditional "Will -Serve" letter including completion of a line extension agreement. (5) Grading and Drainage Plans - A pending wetlands re -delineation map has been prepared in late December for the existing pond area at the Entryway site which should be incorporated into the Applicant's building permit application. The existing gravel parking lot for which the SWFPD's interim facilities are planned should not be considered within a wetland area, according to the current subdivision plat. The Applicant should maintain access to the pond for maintenance purposes/ TC Resolution 18 2017 Page 7of8 (6) Construction Management Plan - The SWFPD should continue to commit to participating in any efforts to coordinate construction activities with other projects occurring in the Village, as might be needed. A traffic control plan should be submitted for review with the building permit application. (7) Remaining Review Comments - The Applicant should respond to any remaining outstanding evaluation comments from the Town with the submittal of the building permit application and during the review of the construction plans prior to issuance of a building permit. Section Three: Severability. If any provision of this Resolution or application hereof to any person or circumstance is held invalid, the invalidity shall not affect any other provision or application of this Resolution which can be given effect without the invalid provision or application, and, to this end, the provisions of this Resolution are severable. I'm sorry that it came down the way it did, but we didn't know if we were going to go through with the changes until about an hour before the Planning Commission meeting. I cautioned against surprising you and the Commission but was overruled under the idea that if the Town felt it was a significant change, we would be tabled and reviewed during a later meeting. The changes can be summarized as follows: - The building footprint was modified to push the building mass away from the northwest corner of the parcel. This was accomplished by eliminating one apparatus bay (actually the wash bay) and moving the offices and storage on the northwest side of the building to where the wash bay was located (which is on the east side of the bays next to the administrative offices). - This reduced the floor area by about 2,500 sf, reducing costs accordingly. - It also moved the building away from the curve on Yarrow Drive, eliminating the visual crowding that may be experienced under the previous design. This was a big concern of the Chapel and Anderson Ranch. - Finally, it eliminated the need to relocate a communications line. This utility relocation would have significant impact on access and parking in the Chapel parking lot during construction. - All living space, including the 6 studio apartments, were retained in the design. Attached is a copy of the presentation I gave the Planning Commission and a copy of the conceptual plans for the revision. There won't be any changes between now and the Town Council/Fire District Board meeting, except a possible a change in the color of the temporary tent. The Planning Commission asked for swaths of the tent fabric so they could get a better idea of the true color options. I delivered those swaths to Cindy yesterday. The SWFPD doesn't care what color is used and will defer to whatever the Planning Commission decides, but we do need a decision by March 1st to order the tent in time for occupancy (April 1). I assume that I will need to prepare and submit a letter to Town Council for their review March 6th. When would you need that by?
