Town Council Resolution 32 2017 111110 1101 111111111111111 1111 1111111110111111111111111111111111111 III RECEPTION#: 648329, R: $43.00, D: $0.00 DOC CODE: RESOLUTION Pg 1 of 7, 06/25/2018 at 09:26:12 AM Janice K.Vos Caudill, Pitkin County, CO TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 32 SERIES 2017 A RESOLUTION ACTING ON APPLICANT'S REQUESTED SUBDIVISION EXEMPTION TO ADJUST THE COMMON LOT LINE ONLY BETWEEN LOT 1, BASE VILLAGE AND THE LICHENHEARTH PROPERTY. WHEREAS, on December 8, 2016 the original Applicant, Snowmass Acquisition Company LLC, applied for a Subdivision Exemption to adjust the common lot line between Lot 1, Base Village PUD Final Plat and the Lichenhearth Condominium Association property exchanging property of approximately 1,480 square feet on undeveloped open space and landscaped areas located between the developed buildings on each site; and WHEREAS, the Lot 1, Base Village PUD Final Plat was created in 2006, and the Lichenhearth property including its building units, access drives and garages was first created or described by the Condominium Map of Lichenhearth in 1968; and WHEREAS, Town Council Resolution No. 20, Series of 1998, approved a subdivision exemption to allow the Snowmass Resort Association to convey certain common area surrounding the Linchenhearth Condominiums to the Lichenhearth Condominium Association and the exemption plat was signed and recorded in February 1999; and WHEREAS, on September 13, 2016 an Improvement Survey Plat was certified showing an approximate 10 foot off-set error in the placement of the easterly property line of the Lichenhearth site next to Lot 1, Base Village PUD Final Plat; and WHEREAS, on February 7, 2017 certain application material items were updated to reflect SV Land Holdings as the new Owner and Applicant; and WHEREAS, the Applicant resubmitted certain updates to the application and mostly the subdivision exemption plat drawings on May 1, July 13 and August 11, 2017 mainly in response to town staff review comments, and the latest version is attached as Exhibit "A"; and WHEREAS, the Town Council was scheduled to review the application on September 18, 2017 pursuant to Section 16A-5-500 to 530 of the Snowmass TC Resolution 32, 2017 Base Village and Lichenhearth Subdivision Exemption for Common Lot Line Adjustment Page 2 of 4 Village Municipal Code ("Municipal Code"), to consider the application, the recommendations of Town Staff, and receive public comment thereon. NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Snowmass Village, as follows: Section One: Findings. Based upon the information contained in the Application, the supplemental or updated information submitted to Town Staff and testimony in the record, the Town Council hereby finds that: 1 ) The Applicant has submitted sufficient information pursuant to Section 16A-5-500 through 520 of the Municipal Code to permit the Town Staff and Town Council an adequate review of the subdivision exemption application for the proposed common lot line adjustment. 2) The application, subject to satisfying the conditions stated below, is consistent with the applicable review standards specified within Section 16A-5-530 of the Municipal Code. 3) According to the Base Village Subdivision Improvements Agreement, pursuant to the Final PUD Ordinance No. 9, Series of 2015, the Developer agrees to grant easements for all existing and proposed trails to be constructed for those easements that do not yet exist, and upon the Town obtaining the necessary easements, the Developer shall complete, at its cost, the trail connections required by the PUD related to the development of Lot 1 of the Project. The trail easement grant off-site on the Lichenhearth property would acceptably fulfill the easement connection needed per the SIA consisting of, "the trail connection west of Building 1 (Treehouse) to the vicinity of the Stonebridge complex and to Carriage Way," with the exception of a further trail easement linkage needed on the adjacent Stonebridge Condominium property of which the Applicant is not bound to provide. Section Two: Action. The Town Council hereby approves the Subdivision Exemption for the common lot line adjustment involving a land area exchange of approximately 1 ,480 square feet between Lot 1 , Base Village PUD Final Plat and the Lichenhearth Condominium Association property, together with the trail easement grant off-site on the Lichenhearth property as described and illustrated in attached Exhibit 'A," subject to the conditions in Section Three below. Section Three: Conditions. The approval granted herein is subject to the following conditions: TC Resolution 32. 2017 Base Village and Lichenhearth Subdivision Exemption for Common Lot Line Adjustment Page 3 of 4 1 ) Following execution, this resolution and its exhibits shall be recorded, at the Applicant's expense, with the Pitkin County Clerk and Recorder. 2) The Applicants shall complete all actions or matters which in the opinion of the Planning Director and the Town Attorney are necessary to satisfy or dispense with the completion, execution and/or recording of all documents necessary to implement the conditions of this Resolution and the requirements of the Municipal Code. Should disagreements arise regarding matters requiring Planning Director approval or completion of the necessary documents that cannot be resolved between Town Staff and the Applicants, the matter will be referred to the Town Council for final direction and/or determination. Section Four: Severability. If any provision of this Resolution or application hereof to any person or circumstance is held invalid, the invalidity shall not affect any other provision or application of this Resolution which can be given effect without the invalid provision or application, and, to this end, the provisions of this Resolution are severable.
