TC Reso 24, 2004 - App of Holy Cross Substation Facility & Underground Tranmission Line Alignment.pdfTOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 24 SERIES OF 2004 A RESOLUTION GRANTING FINAL APPROVAL OF THE HOLY CROSS SUBSTATION FACILITY AND UNDERGROUND TRANSMISSION LINE ALIGNMENT PURSUANT TO RESOLUTION NO. 25, SERIES OF 2003. WHEREAS, Holy Cross Energy, Inc. (the "Applicant") submitted an application for Subdivision Exemption and Special Review on February 28, 2003 (as subsequently amended), for the purposes of locating transmission lines and a substation facility; and WHEREAS, said application requested approval to: 1) construct transmission lines extending from State Highway 82 approximately one-quarter mile south of Brush Creek Road, across Pitkin County Open Space and private properties in Pitkin County to the proposed substation facility site on Parcel 35, the "Hidden Valley" Parcel referenced by Exhibit B, Ordinance No. 10, series of 1987; 2) construct an enclosure for the substation, along with road access, parking, drainage, and landscaping improvements within the "Hidden Valley" parcel; and WHEREAS, Town Council Resolution No. 25, Series of 2003 ("Resolution 25"), granted conditional Subdivision Exemption and Special Review approval on August 11, 2003; and WHEREAS, Resolution 25 specified that the transmission lines were to be placed underground and required that the final transmission line alignment and substation facility plans would be submitted when completed for final Town Council approval; and WHEREAS, said plans were submitted on March 10, 2004 and have been reviewed by Town staff; and WHEREAS, the Town Council has reviewed the final plans, attached hereto as Exhibit "A" and incorporated herein by reference, and heard the recommendations of the Town staff; and WHEREAS, the Town Council finds that the adoption of this Resolution is necessary for the immediate preservation of the public health, safety and welfare. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado, in its capacity to review said application, hereby states the following: Section One: Findings 1. The applicant has submitted sufficient information pursuant to Section 16A- 5-230 of the Snowmass Village Municipal Code (the "Municipal Code") to facilitate review of the proposal by Town staff and the Town Council. 2. The application is being processed in accordance with Section 16A-5-230 of the Municipal Code and is consistent with the applicable review standards of the Municipal Code for the installation of Public Utility Uses, Services, and Facilities, as delineated under procedures for Special Review. 3. The location of the underground transmission lines shall be within the Brush Creek and Highline Road rights-of-way. The alignment will then proceed from the right- of-way up Hidden Valley Road to the substation site as delineated in Exhibit A. 4. The "Conceptual Underground Transmission Line Alignment" reviewed as part of Resolution 25 was not clear whether the alignment would be entirely within TC Reso 04-24 Page 2 of 3 Town rights-of-way. For this reason, the resolution called for a review of the final alignment, erosion control, traffic and construction management plans by the Town Council. It is now clear that the location will be within Town roadways and matters pertaining to the installation will be reviewed and approved by the Public Works Director and Town Engineer as part of the Applicant's road cut and utilities installation permit. 5. The Town Council has reviewed the substation plans and determined that the Applicant should submit a Construction Management Plan addressing ways to minimize site disturbance, construction vehicle parking and other impacts associated with constructing the substation facility. Said plan will be reviewed and approved by the Planning Director prior to the commencement of construction activities. 6. The Town Council has reviewed the substation site and architectural plans and finds that the Applicant has satisfactorily responded to direction previously given regarding landscaping, building design, materials and colors 7. The Town Council finds that this final determination as to the outward appearance and color of the substation facility, as shown on Exhibit "A" is authorized within the land sale contract attached as part of Resolution No. 15, Series of 2003, and shall be subject to the terms and conditions of this Resolution. Section Two: Action. Regarding the Holy Cross Energy Transmission Line and Substation Facilities Subdivision Exemption and Special Review application dated February 18, 2003 (as subsequently amended March 10, 2004), the Town Council hereby acts as follows: 1. Conditional Approval of Underground Alignment. Town Council approves the Applicant's request to construct an underground transmission line within Town rights-of-way subject to said installation being reviewed and approved by the Public Works Director and Town Engineer as part of the Applicant's road cut and utilities installation permit. In addition, the Applicant shall, as reasonable practicable, reclaim any disturbed areas within the 25 foot utility easement to mirror contours of adjacent lands and may regrade adjacent lands to match contours, so that the final topography within the area between Highline Road and the substation facility remains naturally appearing. 2. Conditional Approval of Substation Facility Site Plan. Town Council authorizes the construction a substation facility as shown by the final substation facility conceptual design and site plan in Exhibit "A". Said approval shall be subject to: a. Submitting a detailed Construction Management Plan including: timeline; hours of construction; location(s) for staging of equipment and materials and construction worker parking; and traffic management. Said plan will be reviewed and approved by the Planning Director prior to the commencement of construction activities. b. Prior to the commencement of construction activities, the Applicant shall submit a copy of the site landscape contract to include a one-year warranty by the contractor, including fertilizing watering and weed control. The Town Council previously authorized the Public Works Department to assume maintenance of the landscaping and irrigation upon expiration of the one-year. c. Following placement of vegetation within the utility easements as shown on the landscape plan, said areas that are disturbed by the future reconstruction, repair, change, enlargement, re -phase, operation or maintenance of the underground electric distribution line shall be revegetated in accordance with the plan unless otherwise approved by the Town Manager. Construction details that incorporate the recommendations of the Snowmass Wildcat Fire Protection District ("Fire District") provided at the time Resolution 25 was adopted shall be submitted to the Fire District for review and approval prior to the commencement of construction activities.
