ExhibitBOrdinanceNo10seriesof19872constructanenclosureforthesubstation alongwithroadaccessparkingdrainageandlandscapingimprovements asdelineated onthesiteplanandelevationdrawingsExhibitA ConceptualSitePlanattached heretoandonfileattheTownClerksofficeandincorporatedbyreferencehereinand WHEREASonlythatportionofthetransmissionlinelocatedwithinthelimits ofthe TownofSnowmassVillageisbeingconsideredandiswithinthepurviewofthe Town CouncilhowevertheTownCouncilisconcernedaboutthevisualimpactoftheproposed overheadlinesontheScenicOverlay ConservationEasementintheBrushCreek CorridorheldjointlywithPitkinCountyand WhereasthePlanningCommissionrecommendedapprovaloftheapplication basedonaconditionrequiringanundergroundtransmissionlineandenclosed substation byadoptingResolutionNo6Seriesof2003at theirMay142003meetingand WHEREASaPublicHearingwasconductedduringmeetingsheldbefore the TownCouncilonJune16June30July21andAugust42003toreceivepublic commentandtoidentifymajorissuesandextendedthroughResolutions28 and32 seriesof2003and WHEREASsaidSpecialReviewrequestwasconsideredbythe TownCouncil pursuanttoSection16A5230oftheTown ofSnowmassVillageLandUseand DevelopmentCodeMunicipalCode and WHEREAStheTownCouncilhasreviewedtheapplicationandheard the recommendationsoftheTownstaffreferralagenciesandconsultantsas wellasthe requestsoftheapplicantand WHEREAStheTownCouncilfindsthattheadoptionofthisResolution is necessaryfortheimmediatepreservationofthepublichealthsafety andwelfare NOWTHEREFOREBEITRESOLVEDbytheTownCouncilofthe Townof SnowmassVillageColoradoinitscapacitytoreviewsaidapplicationhereby statesthe following TCReso0325 Page2 SectionOneFindings 1TheapplicanthassubmittedsufficientinformationpursuanttoSection16A5230 of theMunicipalCodetofacilitatereviewoftheproposalbyTownStaffandtheTown Council 2AllpublicnotificationrequirementsasspecifiedwithinSection16A560b ofthe MunicipalCodehavebeensatisfied 3TheapplicationisbeingprocessedinaccordancewithSection16A5 230ofthe MunicipalCodeandisconsistentwiththeapplicablereviewstandardsoftheMunicipal CodefortheinstallationofPublicUtilityUsesServicesandFacilitiesasdelineated underproceduresforSpecialReview 4 ThelocationoftheproposedsubstationfacilityisonunplattedTownownedland zonedOpenSpaceThesubject22acreparcelisproposedtobeconveyed tothe applicantAssuchasubdivisionexemptionneedstobeapprovedby TownCouncil andanexemptionplatwillneedtoberecordedasdelineatedintheMunicipalCode 5 TheTownCouncilhastotheextentnecessaryforandpertinenttothelevelof evaluationandreviewnecessaryforaSpecialReviewdeterminedthattheapplication isgenerallyincompliancewiththeMunicipalCodesubject tosatisfyingthe ConditionsofApprovalcontainedwithinSectionThreeofthisresolution 6Theproposeduseofpublicutilityfacilitiesandservicesispermitted withintheOpen SpacezonedistrictsubjecttoSpecialReviewapproval Nohabitablespaceis proposedthuszonedistrictFARandBuildoutdonotapply Alldimensional limitationsaredeterminedbySpecialReview 7TownCouncilacknowledgestheneedforelectricalutilityserviceimprovementsin ordertomeetbothcurrentandfuturedemandintheTownofSnowmassVillageand findsthattheproposedfacilitiesaregenerallywarrantedandacceptable withthe exceptionoftheconstructionofoverheadtransmissionlines whichwouldhavea seriouslynegativeaestheticimpactontheBrushCreekCorridor animportantvisual andscenicresourceidentifiedintheComprehensivePlan 8Theproposalassubmittedincludestheinstallationofoverheadutilitylines whichis notincompliancewithSection16A4230c1requiringthatallutilities tobeplaced underground AssuchtheTownCouncilhasincludedaConditionofApprovalin SectionThreecallingforplacementofalltransmissionlineswithintheTownboundary undergroundInadditionthevisualimpactsoftheoverheadtransmission linesand towerswithintheBrushCreekCorridorintheTownofSnowmassVillageare unacceptable 9 Section16A4230c2oftheMunicipalCodeprovidesfortheexemptionofcertain utilityfacilitiesfromthisrequirementprovidedtheApplicantdemonstrate thatthey cannotbereasonablyplacedundergroundTheTownCouncilfindstheApplicant has providedsufficientreasontoallowthesubstationfacilitytobeplaced abovegroundas shownwithintheapplication TCReso0325 Page3 10Thelocationoftheundergroundutilitylineshallfollowtherouteoftheexisting undergroundutilitylineeasementsandpublicroadeasementsalongBrushCreek Road in generalconformancewiththeExhibitBConceptual Underground TransmissionLineAlignmentThealignmentwillthenproceedwithintheHighline RoadrightofwayandupHiddenValleyRoadtothesubstationsiteasdelineatedin ExhibitA 11TheTownCouncilhasconsideredseveralalternativesitesforthelocationofthe substationfacilityandfindsthattheproposedlocationdelineatedintheattached ExhibitAlocatedintheHiddenValleyareaofEastVillagetobeacceptableItisthe Councilsintentiontoconveythesubject22acreparceltoHolyCrossEnergyIncfor the sole purpose ofconstructing a substationfacilityand associated utility connections 12Thealignmentofthetransmissionlineengineeringdetailsandarchitecturalfeatures oftheproposedsubstationfacilityhavenotbeensufficientlydevelopedtoalevel necessaryforfinalapproval 13TownCouncilisveryconcernedabouttheimpactsofsitedisturbanceandother constructionimpactsaswellasthevisualintrusionoftheproposedsubstationfacility intoHiddenValleyandalongthecemeteryaccessroadTheCouncilfindsthatthe installationofappropriatelandscapingandsiterestorationmeasuresdesignedto reflectthenaturalcharacteroftheexistinglandscapeasmuchaspossiblewouldhelp mitigatetheseimpacts 14TheTownCouncilfindsthattheprovisionsofSection2920108CRSapplytothe applicationforSpecialReviewsubmittedbytheApplicant 15TheTownCouncilfindsthatSection29201085aCRSprovidesamechanism fortheApplicanttoappealthetermsandconditionsofthisResolutiontothe PublicUtilitiesCommissionasfollows Ifalocalgovernmentdeniesapermitorapplicationofapublicutilityorpower authoritythatrelatestothelocationconstructionorimprovementofmajorelectrical ornaturalgasfacilitiesorifthelocalgovernmentimposesrequirements orconditions uponsuchpermitorapplicationthatwillunreasonablyimpairtheability ofthepublic utilityorpowerauthoritytoprovidesafereliableandeconomicalservicetothepublic thepublicutilityorpowerauthoritymayappealthelocalgovernmentactionto the Applicantsrequesttoconstructanundergroundtransmissionlinesubjectto approvalbyResolutionorOrdinanceofaFinalUndergroundTransmissionLine AlignmentSitePlancontainingthefollowing a AFinalTransmissionLineAlignmentSitePlanforallproposedworkareasand improvementswithinfifty50feetoftheproposedalignmentcenterlinewithinthe TownofSnowmassVillagetownlimitsincluding 2ConditionalApprovalofSubstationFacilitySitePlanTownCouncilauthorizesthe constructionasubstationfacilityasgenerallyrepresentedbytherevisedsubstation
