The build-out table was established long before the Skiing Company vacated the Woodrun Chairlift. The availability of the land under the chairlift was not contemplated. 1 Section 16A-5-300(c)(4)b. of the Code A greater buildout may be approved if the Town Council finds that: the PUD achieves one (1) or more of the purposes described in Subsection(c)(6), Community Purposes for PUDs, and the PUD complies with the other applicable provisions of this Subsection (c), General Restrictions, the standards of Section 16A-5-310, Review Standards, and any other applicable provisions of this Code. 2 Section 16A-5-300(c)(4)b. of the Code (continued) No buildout may be permitted to exceed one hundred percent (100%) of the [number set forth in the build-out table], except that . . . under unique and exceptional circumstances where . . . the resulting development will, for good cause shown, exceed the PUD review criteria standards, a reconsideration and amendment of the future buildout analysis chart allocation . . . may be considered. 3 Unique and Exceptional Circumstances Exist The Skiing Company’s vacation of the Woodrun Chair Ski Lift Easement “created” a substantial amount of developable land, freeing The Enclave from the constraints which existed at the time it was established in the late 1970s and early ‘80s – and when the Buildout Chart was established. 4 Community Purposes Provided Under § 16A-5-300(c)(6) a. Provision of restricted housing above that required by Code. b. Encourage sustainable development – enhanced landscape plan (provided at Final), more open space than required d. Encourage better design – the current exteriors of the Enclave continue to reflect early-1980s quality and design. The new exteriors will incorporate durable, low maintenance and resource-efficient building materials, and energy-efficient features such as PV roofing products e. Develop necessary public facilities – if the application is approved, the Enclave will provide temporary and permanent easements to the Town for the construction and maintenance of the bus stop. 5
