Michael Manchester called to order the Regular Meeting of the Snowmass Village Town Council on Monday, November 25, 2002 at 2:10 p.m. Item No. 1: ROLL CALL COUNCIL MEMBERS PRESENT: STAFF PRESSENT: PUBLIC PRESENT: SNOWMASS VILLAGE TOWN COUNCIL REGULAR MEETING MINUTES November 25, 2002 Mayor T. Michael Manchester, Douglas Mercatoris, Richard Virtue, Bill Boineau, and Arnold Mordkin All Council Members were present Madeliene Osberger, Mary Harris, John Quigley, Reed Lewis, Kyle Sharp, Mary Evans, Rick E. Griffin, Pike Peterson, Robert Purvis, Peter D. Moore, Jeremy Swanson, Kristin Everhart, Paul Shepherd, Ivan Perin, and Deane L. Sadler. DISCUSSION AGENDA Michael Segrest, Town Manager; Carey Shanks, Assistant to the Town Manager; Chris Conrad, Planning Director; Steve Connor, Town Attorney; Hunt Walker, Public Work's Director; David Peckler, Transit Manager; and Donna J. Garcia Spaulding, Second Deputy Town Clerk Item No. 2: INTERVIEW APPLICANTS FOR THE MARTKETING AND SPECIAL EVENTS BOARD Mayor Manchester explained that today's packet information contains nominations from specific industry groups, as well as applications for two At- Large positions to fill seats on the newly developed Marketing and Special Events Board. Segrest informed Council that applicant Deane L. Sadler has withdrawn his application for an At -Large position on the Board. Council interviewed Mary Harris and John Quigley, applicants representing the Lodging Industry; Reed Lewis representing the Retail Industry; Kyle Sharp representing the Restaurant Industry; and At Large applicants 11 -25 -02 Page 2 of 5 including Bob Purvis, Mary Evans, Rick E. Griffin, Pike Peterson, and Kristin Everhart. After completing the interviews, Council voted by secret ballot and Mary Harris was selected to represent the Lodging Industry. Reed Lewis was selected to represent the Retail Industry. Applicant John Quigley requested that he be considered for an At -Large position. Council stated their appreciation to all applicants for their interest in serving on this Board. NOTE: Council took a 15- minute break and reconvened at 4:40 p.m. Mayor Manchester stated that applicant interviews for a representative for the the Food and Beverage Industry and the two At -Large positions would be held at the December 2, 2002 Regular Town Council Meeting which will be scheduled to begin at 4:00 p.m. Item No. 3: PUBLIC NON AGENDA ITEMS There were no Public Non Agenda items. Item No. 4: PUBLIC HEARING AND ACTION RESOLUTION NO. 62, SERIES OF 2002 TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF A RESOLUTION ON AN APPLICATION BY INTRAWEST RESORTS INC. FOR AN ANNUAL TEMPORARY USE PERMIT TO ALLOW A DISCOVERY CENTER AT THE BASE OF FANNY HILL (Public Hearing Continued from 11 -18 -02 and Resolution Tabled from 11/- 18 -02) Mayor Manchester opened the Public Hearing at 5:00 p.m. Council requested that the Discovery Center be closed at 6:00 p.m. and the lights be turned off by 6:30 p.m. Council requested that an additional sign be posted on the inside of the structure, that language be added to Condition 16 which states that "no other promotional information is available except that pertaining to Base Village. There being no comment from the public, Mayor Manchester closed the Public Hearing at 5:15 p.m. Council Member Mercatoris made a motion to approve Resolution No. 62, Series of 2002 as amended, seconded by Council Member Virtue. The motion was approved by a vote of 5 in favor to 0 opposed. Item No. 5: RESOLUTION NO. 64, SERIES OF 2002 CONSIDERATION OF A RESOLUTION APPOINTING MEMBERS 11 -25 -02 Page 3 of 5 TO THE TOWN OF SNOWMASS VILLAGE MARKETING AND SPECIAL EVENTS BOARD. Council Member Mercatoris made a motion to table Resolution No. 64, Series of 2002, to the December 2, 2002 Town Council Meeting, seconded by Council Member Virtue. The motion to table was approved by a vote of 5 in favor to 0 opposed. Item No. 6: RESOLUTUON NO. 67, SERIES OF 2002 CONSIDERATION OF RESOLUTION EXPRESSING APPRECIATION TO ROBERT PURVIS FOR HIS SERVICE AS A MEMBER ON THE SNOWMASS VILLAGE PLANNING COMMISSION, AND AS COUNCIL MEMBER ON THE SNOWMASS VILLAGE TOWN COUNCIL Mayor Manchester read Resolution No. 67, Series of 2002 expressing appreciation to Robert Purvis for his service as a Member on the Snowmass Village Planning Commission and as Council Member on the Snowmass Village Town Council, and presented him with a plaque of appreciation and a personal gift. Mayor Manchester stated that there would be a celebration following the Meeting in honor of Bob Purvis, at the Snowmass Club and all invited the public to attend. Council Member Virtue made a motion to approve Resolution No. 67, Series of 2002, seconded by Council Member Mercatoris. The motion was approved by a vote of 5 in favor to 0 opposed. Item No. 7: MANAGER'S REPORT SVRA Website Town Manager Mike Segrest provided Council with an up -date on the Snowmass Village Resort Association (SVRA) Website. He reported that Brett Huske has confirmed that SVRA does not intend to abandon its website. Request for Joint Meeting with County, RFTA and CDOT Segrest stated that he has attached a letter from the County requesting a Joint Meeting regarding transportation impact relating to Base Village. He explained that the County Manager suggested that the Joint Meeting be held after the Transportation Impact Analysis becomes available. Council agreed. Virtue questioned the validity of the material provided to Council and requested that staff further investigate the information before further distribution. Segrest stated that there are two documents that interact including the Traffic Impact Analysis and the Fiscal Impact Analysis, and stated that staff will be examining both from the standpoint of Town revenue generated and costs associated. 11 -25 -02 Page 4 of 5 Council requested that the Town Manager write a letter of response to the County. Marketing and Special Events Tax Segrest referred to a letter from Town Attorney Steve Conner, which responded to inquiries from the Lodging Industry regarding whether the new tax applies to rentals that will occur after December 1, 2002 but which were booked and partially or fully paid for prior to December 1, 2002. Town Attorney Steve Connor stated that it was his opinion that the tax applies language is based on the transaction date, which is at the time of occupancy not at the time of when payment. He reported that he has discussed the issued with the State Department of Revenue, which was not however, able to provide Connor with a statute supporting their interpretation. After much deliberation and further discussion, Council agreed with the Town Attorney's recommendation. Council requested that staff work on a way to compensate the public as a public relations gesture. Segrest stated that taxpayers could submit a request to the Town for refund, if they feel they have been taxed inappropriately. Item No. 8: DISCUSSION COMMITTEE REPORTS /COUNCIL COMMENTS /CALENDARS Parking for Mountain Opened Early Council Member Virtue requested that staff investigate which of the numbered parking lots would be most appropriate as timed parking when the mountain is opened early. He also requested that staff enforce the timed parking in Lot 6 and assign a Traffic Control Officer for enforcement. Daly Townhomes In response to an inquiry by Council Member Virtue, Town Attorney Steve Connor stated that he should have the final redraft of all the maps by November 26, 2002. He reported that plat maps and condominiums documents should be finalized within a week. Oxygen Trailer Council Member Mordkin requested that staff investigate whether Mountain Oxygen has a business license in order to conduct business in Snowmass Village. Lights at Rodeo Mayor Manchester requested that the lighting be repaired above the information booth located near the Rodeo lot. 11 -25 -02 Page 5 of 5 Magic Wand Request Mayor Manchester requested Council Members write down a "magic wand" list of things they would like to accomplish during the Council Retreat of December 3, 2002. Item No. 9: EXECUTIVE SESSION Item No. 10: ADJOURNMENT Submitted by: Donna J. THE TOPIC FOR DISCUSSION IN THE EXECUTIVE SESSION WILL BE PRIVILEGED ATTORNEY\CLIENT MATTERS TO DISCUSS SEVEN STAR ANNEXATION. The Town Manager stated that this item would be discussed at the December 2, 2002 Town Council Meeting. There being no further business, Council Member Mercatoris made a motion to adjourn the Meeting, seconded by Council Member Virtue. The motion was approved by a vote of 5 in favor to 0 opposed.
