Overall responsibility for this event is the Department of Veterans' Affairs (aka VA) in association with the Silvertree Hotel. The Application /Operations Plan is included as Attachment 1; Event Schedule is attached as Exhibit A; Transportation Schedule- Exhibit B; and Parking Plan- Exhibit C. 3. Preparation and set -up for the event begins on Wednesday, March 23. The Winter Sports Clinic starts Friday, March 25 and concludes on Saturday, April 2. Hours of operation are 24 hours -a -day for the duration of this special event. 4. Taste of Snowmass parties are scheduled in the Snowmass Mall on Sunday, March 27 (3:30 PM- 5:30 PM) and Friday, April 1 (awards /dining 10:30 AM- 2:30 PM). 5. Attendance is expected to include approximately 425 Disabled American Veterans and 1,500 others that include family members, volunteers, Silvertree staff and security. B. Authorization 1. Use of any privately owned property, including the location of any vehicles, equipment or materials within said property, is not authorized without the express written approval of the landowner (see Exhibit D- Authorization). 2. Applicant will coordinate with the property owners and Town regarding the scheduling of activities, set up, take down and any required maintenance and /or repair. 3. Applicant (VA) and /or Silvertree Hotel, shall provide advance notice to mall business owners, lodging operators and general public that public parking activities in Village Numbered Lots 2 8 and access /deliveries on Elbert and Fall Lanes will be temporarily affected between March 24 and April 2. 4. Applicant has permission to erect a climbing wall and transit access ramp(s) within Daly Lane /Circle and park an equipment storage trailer along Fall Lane under the supervision and approval of the Fire and Police Chiefs or designees. 5. Applicant shall coordinate with the Roaring Fork Mountain Club (formerly The Blue Door) to minimize conflicts with member /guest arrivals and departures. C. General Conditions 1. Applicant is responsible for full and complete compliance with all applicable Federal, State and Local laws and regulations in the production and management of this event. DAVNA WINTER SPORTS CLINIC TUP -2009 2. Applicant is responsible for the supervision and control of all activities conducted during this special event to ensure that the terms and conditions of this permit are satisfied. 3. Applicant shall promptly notify the Snowmass Village Planning Department (923 -5524) of any additions, modifications or amendments to this temporary use. Any such changes should be insubstantial in nature and not in conflict with the terms, conditions or review standards relative to this permit. Adjustments or other changes to this permit are not permitted without written approval of the Town Planning Director or designee. 4. Applicant acknowledges that due to the nature of this type of event, certain impacts associated with the temporary use that may affect surrounding properties or Town road and parking lot operations, may not have been apparent at the time this application was made. In the event the Applicant or Town receives any complaint arising from this event, Applicant shall exhibit due diligence in attempting to resolve the problem. Failure by the Applicant to demonstrate that reasonable efforts were made to resolve a significant majority of any such complaints shall be cause for modification or termination of this permit. 5. The temporary use activities shall not generate debris, excessive noise, smoke, odors, traffic or congestion that will adversely or unreasonably affect the Town, surrounding businesses, lodging operations or residences. 6. No penetrations of concrete, asphalt or other surfaces within the Town roadways or parking lots shall be permitted without the express authority of the Public Works Director or Town Manager. 7. Any Town property that is damaged or destroyed during the period specified within this permit as a result of activities conducted by, or under the direction or control of the Applicant shall be repaired or replaced to the satisfaction of the Town Manager at Applicant's expense within fourteen (14) days of the conclusion of this event unless other arrangements are made in writing with the Town Manager. A walk -thru inspection may be requested by the Applicant prior to the scheduled events to establish an existing conditions report. D. Police and Fire Departments 1. All requirements of the Town Police Chief (923 -5330) and Fire Chief (923 -2212) or designees, whether imposed prior to or during this event, must be satisfied and shall be considered conditions of this permit. 2. Except as authorized by this permit, all required fire lanes shall remain unobstructed at all times unless further authorization is obtained from the Snowmass Wildcat Fire Protection District Fire Chief (923 -2212) or designee. E. Event Security and Traffic Control 1. The Town is not responsible for providing security for these activities or the Applicant/participants' vehicles and /or equipment. It is recommended that Applicant and /or Silvertree Hotel make appropriate security arrangements and coordinate with the Town Police Chief. 2. Town Police are not able to assist with traffic control; Applicant is responsible for providing adequate staff with reflective, safety vests to direct and control vehicles at the entrance to Elbert Lane on Upper Carriageway. VA/DAV WINTER SPORTS CLINIC TUP -2011 3. Applicant and /or Silvertree Hotel shall provide sufficient personnel with appropriate safety vests, if requested, for traffic control at Elbert Lane, Village Numbered Lot 8 and adjacent area to ensure that all requirements of the Town Police Chief, Fire Chief, Public Works Director or designees are satisfied. F. Event Parking and Automobile Towing 1. Village Lot 8 is reserved for "Official DAV Transportation Vehicles- ONLY." Village Lot 2, the back portions of the upper and lower lots, may have designated areas for VA bus /truck parking and plug -ins for electricity. See Exhibit C- Parking Plan. 2. Additional large trucks may be parked in the back section of Village Lot 11 or 12; actual vehicle parking locations shall be confirmed with the Police Department. The dirt portion of the Rodeo Lot may also be available for truck, vehicle and /or trailer parking; availability and actual parking areas shall be coordinated and approved by the Public Works Department (923 5110). 3. Applicant is responsible for installing appropriate barricades and posting notice(s) at the entrance to Village Numbered Parking Lots 2 8 and along Fall Lane at least 24 hours before the event to inform the public of the restricted date(s) and intended activities of the Applicant. With adequate advance notice, barricades may be obtained from the Town's Road Department; contact John Baker at 923 -5110. 4. It is the Town's position that fundamental legal constraints prevent the Town from authorizing the towing of a vehicle that was legally parked in a public roadway or parking lot prior to or during a Temporary Use granted by the Town. 5. Should it become necessary, Applicant shall contact the nearby businesses, lodging operators and property owners in order to locate the drivers of any unauthorized vehicles and request that the cars be relocated to another legal parking area. If all else fails, and the organizers absolutely need cars removed from the area, Applicant may be advised to contact a licensed towing service and assume total responsibility for the relocation process. The Police Department shall be provided with pertinent information on each towed vehicle so they are prepared to assist drivers in locating and reclaiming their vehicle. 6. All activities and parking undertaken by Applicant and /or Silvertree Hotel as part of this event, except as stipulated within this permit, shall not be located on Town roadways and shall not impede normal traffic movement. G. Transportation 1. All baggage is to be dropped off and loaded into trucks on Fall Lane by United Airlines. Heavy move -in occurs Friday, March 25 and Saturday, March 26 with departures scheduled for Saturday, April 2 and Sunday, April 3. 2. Event transportation is being staged in Elbert Lane /Conference Center Circle; the Bus Transportation Schedule with activity destinations is included as Exhibit B. H. Public Health and Safety 1. Applicant shall coordinate with the Aspen /Pitkin County Environmental Health Department regarding activity involving food service and will be responsible for satisfying all applicable health code and sanitation regulations. VA/DAV WINTER SPORTS CLINIC TUP -2011 2. Medical and /or emergency services will be activated by dialing 911. 3. A Medical Room will be located in the Bedford Ballroom; Applicant has its own staffing with 24 -hour on -call nurses and doctors. I. Alcoholic Beverages 1. There is NO Special Event Liquor License for this event. All event functions with alcohol will be hosted in the Silvertree Hotel and Conference Center, both licensed premise areas. J. Clean up and Maintenance 1. At the conclusion of the event, all barricades, signage, ramps, equipment and trash shall be removed to the appropriate location(s) and all affected areas shall be cleaned/ restored to the pre -event condition by the Applicant. K. Insurance, Indemnification and Attorney Fees 1. At all times during the term of this permit the Applicant shall maintain in full force and effect a comprehensive public liability insurance policy. The amount of insurance and extent of coverage shall be established by the Town Manager or designee and, if applicable, private property owners. If at any time during the term of this permit, the Applicant's insurance coverage lapses, is cancelled or suspended, this permit shall automatically terminate and the Applicant shall cease operations hereunder. A Certificate of Insurance shall be provided to the Town prior to commencing the event (see Exhibit E- Insurance). 2. Applicant agrees to indemnify and hold the Town harmless from all cost, loss, damage, expenses (including attorney and expert fees), and claim of liability of any and every kind which may arise as a result of activities in which Applicant is engaged or over which the Applicant has control with respect to the use of the above described property pursuant to this permit. The forgoing shall obligate Applicant to defend any claims, suits, or other proceedings naming the Town as a defendant on any claim which may arise as a result of the use of the above described property pursuant to this permit. 3. Attorney Fees. In the event litigation is necessary to enforce the rights of the Town under this permit, the Town shall be entitled to reimbursements of its reasonable attorney fees and costs of suit, actually incurred in the litigation, as part of its judgment or award.
