PURPOSE Allis) ACTION REQUESTED OF COUNCIL To receive public comment on the attached project list, and consider the public input when developing the 2012 Road Fund Bid package. No action by Council is necessary. II. BACKGROUND Find attached a draft list of Road Fund projects for 2012. It is anticipated that a majority of the funds available will be used to perform asphalt overlays and chip seals on the roads listed. In March of 2012 staff will inspect the roads again, make additions or deletions to the project list, and develop an asphalt overlay bid package in April of 2012. This year we built five soil nail retaining walls. Two of the walls were built to prevent both Wood Road and Ridge Road from failing while the other three walls were built in the heart of West Village. To preserve access to both the Upper and Lower Villages soil nail walls were installed to retain Upper Lot 6 and Upper and Lower Lot 7. During 2010 and 2011 staff feels it has constructed or replaced the most critical retaining walls. Also note the Town has budgeted $800,000 in 2012 for its contribution to the Brush Creek/ Wood Road Roundabout. It was originally scheduled for 2007 before Related Westpac folded. Staff has always kept it in the current year's budget in case a new Base Village owner wanted to complete the project. Although the Base Village foreclosure was recently finalized, I assume the Banks or a subsequent owner will not be ready to construct the roundabout for several years. PURPOSE AND ACTIONS REQUESTED OF COUNCIL: Review and approve Resolution No. 28, Series of 2011. A Resolution establishing the property tax mill levy for the Town of Snowmass Village. II. DISCUSSION ISSUES Resolution No. 28, Series of 2011 establishes the property tax mill levy for the year 2012. The Pitkin County Assessors Office provided the Town with the estimated assessed valuation in August for use in the budget process. By December 10 of each year, the County Assessor must recertify the assessed valuation to each entity. By December 15 of each year, the Town must certify the mill levy to Pitkin County. This resolution meets that deadline. The Town is increasing the overall Town mill levy from 7.356 to 8.940 although the amount of property tax collections will be decreasing by $544,683. This is primarily a result of the 26% decrease in the Towns assessed valuation. Attached is a comparison of the mill levies assessed for 2011 and 2012 including a comparison of the property tax per $1 M of market value for both residential and commercial property. Just below the $1 M market value comparison is another comparison using the $1 M of market value for 2011 and $740K of market value for 2012 collections (which is a 26% decrease the same decrease as the overall Town's assessed value). III. G` o� OC TC PACKET 12 -12 -11 SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 28 SERIES OF 2011 A RESOLUTION LEVYING GENERAL PROPERTY TAXES FOR THE YEAR 2012 TO HELP DEFRAY THE COST OF GOVERNMENT FOR THE TOWN OF SNOWMASS VILLAGE, COLORADO; AND TO PAY GENERAL OBLIGATION BOND PRINCIPAL, INTEREST AND RELATED COSTS; AND FOR THE TOWN'S ROAD IMPROVEMENT PROGRAM, FOR THE 2012 BUDGET YEAR. WHEREAS, the Town Council of the Town of Snowmass Village has adopted the annual budgets in accordance with the Local Government Budget Law on November 7, 2011; and WHEREAS, the amount of money necessary to balance the 2012 budget for general operating expenses is $336,584; and WHEREAS, the amount of money necessary to pay General Obligation Bond principal, interest and related costs for the Droste Conservation Easement, Recreation Center and the Community Swimming Pool is $1,068,937; and WHEREAS, the amount of money necessary to fund the Road Mill Levy Fund is $2,573,271 and WHEREAS, the amount necessary to help fund General Fund Transportation costs is $357,170; and WHEREAS, the amount necessary to fund the Droste Property purchase by Pitkin County is $200,200; and WHEREAS, the 2011 valuation for assessment for the Town of Snowmass Village, Colorado, as certified by the County Assessor is $514,654,130. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One: Action 1. That for the purposes of meeting all general operating expenses of the Town of Snowmass Village during the 2012 budget year, there is hereby levied a tax of .768 mills less a temporary mill levy reduction of .114 for a net mill levy of .654 mills upon each dollar of 7 TC PACKET 12 -12 -11 11 -28 Page 2 the total valuation for assessment of all taxable property within the Town for the year 2012. 2. That for the purpose of paying General Obligation Bond principal, interest and related costs for the Droste Conservation Easement, Recreation Center and the Community Swimming Pool, there is hereby levied a tax of 2.077 mills upon each dollar of the total valuation for assessment of all taxable property within the Town for the year 2012. 3. That for the purpose of funding the Road Mill Levy Fund, there is hereby levied a tax of 5.000 mills upon each dollar of the total valuation for assessment of all taxable property within the Town for the year 2012. 4. That for the purpose of funding Transportation Services in the General Fund, there is hereby levied a tax of .694 mills upon each dollar of the total valuation for assessment of all taxable property within the Town for the year 2012. 5. That for the purpose of funding the Droste property purchase by Pitkin County in the General Fund, there is hereby levied a tax of .389 mills upon each dollar of the total valuation for assessment of all taxable property within the Town for the year 2012. 6. That for the purpose of receiving taxes abated and refunded, there is hereby levied a tax of .126 upon each dollar of the total valuation for assessment of all taxable property within the Town for the year 2012 to receive $64,846. 7. That the Finance Director is hereby authorized and directed to immediately certify to the County Commissioners of Pitkin County, Colorado, the mill levies for the Town as hereinabove determined and set. SUMMARY OF PROJECT Add 2 members to the Board, reclassify representation on the Board, Create new Advisory Committee and re- direct Advisory Committee purposes. Require approval of MGSSE business plan. III. BACKGROUND MGSSE recommended most of the revisions and Council desired one as well. IV. STAFF RECOMMENDATIONS AND FINDINGS Staff recommends Town Council approve Ordinance No 6. 10 TC PACKET 12 -12 -11 TOWN OF SNOWMASS VILLAGE TOWN COUNCIL ORDINANCE NO. 6 SERIES OF 2011 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE XIV OF THE TOWN OF SNOWMASS VILLAGE MUNICIPAL CODE, REVISING THE PROVISIONS FOR THE COMPOSITION, POWERS AND DUTIES AND PROVIDING AN ADDITIONAL ADVISORY COMMITTEE FOR THE MARKETING, GROUP SALES AND SPECIAL EVENTS BOARD OF THE TOWN OF SNOWMASS VILLAGE WHEREAS, the electors of the Town of Snowmass Village determined that the Town would benefit from instituting a lodging tax and directed the revenue from such a tax be used for sales and marketing programs to attract business for the Town of Snowmass Village as a whole; and WHEREAS, the Town Council has determined that the most desirable method to provide broad and diverse representation on the Board for all interested parties to achieve such purposes and goals is to amend the composition, powers and duties, and provide an additional advisory committee for the Marketing, Group Sales and Special Events Board of the Town of Snowmass Village; and WHEREAS, the Town Council determined the method to insure such broad and diverse representation would be to enlarge the composition, amend the powers and duties and provide an additional advisory committee to assist the Board and better reflect its mission; and WHEREAS, the Town Council finds that the adoption of this Ordinance is necessary for the immediate preservation of the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED, by the Town Council of the Town of Snowmass Village that the following Sections of Chapter 2, Article XIV shall be hereby amended to read as follows: 1. That "Sec. 2 -313. Composition." shall be amended to read as follows: The Marketing, Group Sales and Special Events Board shall consist of nine (9) members and one (1) "ex- officio member. The members of the Board, subject to the provisions of Section 2 -316 of this Code, shall be the following: (a) three (3) nominees of the Snowmass Village lodging industry nominated from the lodging businesses in Snowmass Village; 11 TC PACKET 12 -12 -11 (b) one (1) nominee of the Snowmass Village retail industry; (c) one (1) nominee of the Snowmass Village food and beverage industry; and (d) three (3) members at- large; and (e) one (1) "ex- officio" member of the Board to be appointed by the Town Council to represent the on -going development business in the Town of Snowmass Village. Said "ex- officio" member of the Marketing, Group Sales and Special Events Board shall be a non- voting member but shall enjoy all other rights of Board membership, including the right to be present during executive sessions of the Board. Said "ex- officio" member position may or may not be appointed from time to time in the discretion of the Town Council. 2. That "Sec. 2 -314. Advisory Committee" shall be amended to read as follows: The Marketing, Group Sales and Special Events Board shall create and appoint the members to three (3) Advisory Committees to assist the Board in the exercise of its duties. A Marketing, Group Sales and Special Events Board member shall chair each Advisory Committee to provide cohesion between the Board and committee. Preference for committee members will be that members are employed within the constituency group they represent. The Group Sales Advisory Committee is intended to be made up substantially of members of the lodging constituency group that support the success of the Marketing, Group Sales and Special Events Board and shall advise the Marketing, Group Sales and Special Events Board on group sales budgets, programming and operations. The Marketing Advisory Committee is intended to be composed of members from related hospitality industries that support the success of the Marketing, Group Sales and Special Events Board and shall advise the Marketing, Group Sales and Special Events Board on marketing programs, campaigns and the like. The Events Advisory committee is intended to be made up of members engaged in the event creation, promotion and operation industry that support the success of the Marketing, Group Sales and Special Events Board and shall advise the Marketing, Group Sales and Special Events Board on special and recurring event creation, promotion and operations. The Board will strive to include representation by members of specific industries, such as the transportation industry, and entities such as the Aspen Chamber Resort Association, the Aspen Skiing Company, the Snowmass 12 TC PACKET 12 -12 -11 Lodging Association, the Snowmass Resort Association, Stay Aspen Snowmass, nonprofit cultural organizations, and the like. 3. That "Sec. 2 -320. Powers and Duties" shall be amended to read as follows: In addition to carrying out its purpose, the Marketing, Group Sales and Special Events Board shall have the following powers and duties: a. develop programs and policies to accomplish its purposes; and b. authorize the Town Manager to enter into contracts or agreements to carry out its purposes, including administrative support; and c. direct the expenditure of funds for marketing, including print, electronic media as well as mail and direct mail solicitation; for public relations; and administrative expenses; and d. create, promote and execute special events; and e. prepare an annual budget for approval of the Town Council; and f, coordinate with the Town Manager to insure monies are spent consistently with the approved budget for the Board; and g. annually provide, for approval by Town Council, a business plan that includes relevant performance standards; and h. make quarterly reports to Town Council showing performance of the approved business plan. Prior to making a report to Council, the Marketing and Special Events Board and Town Council will mutually agree to a report format. 4. If any provision of this Ordinance or application hereof to any person or circumstance is held invalid, the invalidity shall not affect any other provision or application of this Ordinance which can be given effect without the invalid provision or application, and, to this end, the provisions of this Ordinance are severable.
