On October 18, 2004, the Town Council of the Town of Snowmass Village passed Ordinance No. 21, Series of 2004 (the "PUD Ordinance "). The PUD Ordinance was for the development of properties known as Base Village, Fanny Hill and Sinclair Meadows, The PUD Ordinance was recorded in the Official Records of the Pitkin County Clerk and Recorder on February 2, 2006 at Reception No. 520481 along with the Base Village PUD Final Plat which was recorded in Book 77, Page 30, Reception No. 520483 of the Pitkin County Records. It is our intent to allow fully licensed electric Vehicles, As shown in attachment to this document, to travel along the emergency services road to improve the guest experience, reduce automobile traffic, and to minimize parking impact. .A Description, Explanation, and Clarification of our Submission Pursuant to our application I felt it necessary to define our request, justify our logic and explain the reasoning for pursuing such a change. In line with the original PUD I am sure it was envisaged that all sections of the development would be complete including other hotels and the arrivals center. Clearly at this time, and for the foreseeable future, this is not the case. At this time the Viceroy Snowmass is the preeminent Hotel operation in base village. We are bringing thousands of guests to Snowmass bringing taxes, revenue and livelihood to those of us who benefit from tourism. The hotel has been, by virtue of the non completion of the total development, been isolated on the periphery of base village. It is our desire to bring Viceroy Snowmass and all its Local, National and international guests into a reasonable and easily accessible position with base camp. Viceroy Snowmass Annual Temporary Use Permit January 2011 MOMMOMMOM Our operating Guidelines would include: • We wish to operate the vehicle under this auspice for a 12 month period up until the permit renewal is approved. • The vehicle would run 7 days a week on an as needed basis, S am till 11 pm • The vehicle would run only on a request basis, as needed by the guest. For return from the plaza the guest will be advised to call from the plaza, to the valet/ hotel, in order to secure the transport. • The route will be from the Front door of the Viceroy Snowmass to the Arrivals Center (building 7) and return. • After just a week's data we are averaging around 30 return trips per day to the tree house. Over 80% of these are happening between 830am and 4 pm. • We would appreciate designated signage for Drop Off /Pick location if the town deems it appropriate, adjacent to the Arrivals center. • All Traffic rules will be adhered to and the vehicle will not exceed 15 miles per hour on the fire lane. • An Automatic gate opener will be provided to us for access from base village. The gate will only be opened on entry and exit as needed. It will be immediately closed upon Exit /Entry • Viceroy Snowmass will maintain the Snow accumulation either side of the fire lane on Wood Road Footpath to ensure maximum visibility. • The vehicle will have additional reflective decaling if required. • It is understood that all pedestrians have right of way on the Fire lane and the vehicle will be operated accordingly. • All operators will be fully licensed drivers. All drivers will be carrying a Radio/ Cell phone so they are in immediate contact with the hotel if so needed. The vehicle/ drivers are fully insured and the TOSV will be a named recipient. ® The vehicle is a 10 seat (9 Passenger) Star electric vehicle that is legally registered in the state of Colorado. The vehicle is fitted with snow tires appropriate for street use and our environment. It has a fitted reversing alarm (beep) when reverse is engaged. g We will only operate in adherence to the Colorado Road laws.and to the manufacturer's specification for this legally street registered vehicle and we have already ordered a specific Ski rack for the vehicle that confirms legally and to the vehicle manufacturer's specification. Viceroy Snowmass Annual Temporary Use Permit January 2011 I9 fi6 111 Our desire to use the Fire lane has been, with stipulations, endorsed by the Fire Chief and Fire Marshal. Letter attached. It has been endorsed by Lowes Enterprise, the receiver for the development. Letter attached. We would of course work within these stipulations though I would like to expand on some of them for clarity. 1. Access would be approved for the Viceroy Hotel's specific passenger electric carts only and not gasoline driven vans or passenger cars. We have only the intent to use Our legally street registered, purpose built Electric vehicle. Pictures are attached. 2. The electric carts would only be operated by trained hotel staff. We have trained and licensed drivers for this legally street registered vehicle that comply completely with our umbrella insurance coverage for the hotel. The vehicle is fitted with snow tires appropriate for street use and our environment, 3. The electric carts should not be overloaded with passengers or ski equipment. (One seat one equals passenger.) We will only operate in adhere to the Colorado Road laws and to the manufacturer's specification for this legally street registered vehicle and we have already ordered a specific Ski rack for the vehicle that confirms legally and to the vehicle manufacturer's specification. 4. Electric carts must be manned by trained hotel staff within the fire access at all times. At no time would the vehicle be unattended on the fire lane. Moreover the desire is to operate only on an as needed basis subject to a response from a guest to be taken to base camp or returned the hotel. This negates any unnecessary traffic across the road or on the lane. We will only have trained and licensed drivers for this legally street registered vehicle that comply completely with our umbrella insurance coverage for the hotel. 5. Parking of the electric passenger carts within the fire access would not be permitted. As stated above this is a Pick up / Drop off service in direct response to a guest need. We also realize that this would entail that the electric carts, carrying passengers, would be driven across Wood Road unto the Emergency lane, hence the trained staff operators only provision. Special care and responsibility for passenger safety must be fully realized by the Viceroy Hotel. Presently there is an expectation that the hotel would deliver its guests to lot C for access to Base camp. Aside from the obvious inconvenience to our guests of Snowmass it should be noted that to achieve this the Electric Vehicle has to turn left across traffic. Clearly the Licensed driver must adhere to all road rules at this point. There is in fact a stop sign at the ingress /egress point of our drive that our driver must and will comply with. I suggest the speed of passage straight to the fire lane is more favorable than making this legal left turn. I have attached a verification photograph. Additionally it should be noted that at this point on the road there is already a marked pedestrian crossing, pedestrian crossing signage and speed indication of 20MPH. I have attached photos for verification. Ancillary, but pertinent our efforts and that of the town of Snowmass, it is our desire to forward the efforts of sustainability and the green movement so applicable to our environment. This purpose built legally street registered vehicle will negate, in large part, the utilization of out V8 Chevrolet Yukon fleet for the transportation of our guests in the Snowmass village area. The combination of this easy access with its capability to carry twice the number of guests of the Yukon at one time must be seen as a step forward in transportation efforts ecologically. One further key point to note: While I would like access all the way through to the outdoor / walking mall our application is truly only asking for access to the visitors center. We are able to pick up and drop off safely and can complete a safe and simple turn at that point to return to the hotel. TEMPLEMAN Russ, Chief Sowles and I recently had discussions with the Viceroy Hotel concerning the possibility of their access to the fire lane easement from the Wood Road entrance to the Village Level behind the Arrival Center in Base Village. Specifically they wish to better accommodate their guests with access to Base Village with the aid of passenger electric carts. We feel that this could be accomplished without compromise to fire and life safety with the following conditions being imposed: 1. Access would be approved for the Viceroy Hotel's specific passenger electric carts only and not gasoline driven vans or passenger cars. 2. The electric carts would only be operated by trained hotel staff. 3. The electric carts should not be overloaded with passengers or ski equipment. (One seat one passenger.) 4. Electric carts must be manned by trained hotel staff within the fire access at all times. 5. Parking of the electric passenger carts within the fire access would not be permitted. 6. A provision be made that abuse of this fire lane access could result in the revocation of this approval. We also realize that this would entail that the electric carts, carrying passengers, would be driven across Wood Road unto the Emergency Lane, hence the trained staff operators only provision. Special care and responsibility for passengers safety must be realized by the Viceroy Hotel, much like any chauffer driven vehicle within our resort. remain open to further discussion on any concerns that the Town of Snowmass Village may have on the matter.
