12-12-11 Town Council MinutesCALL TO ORDER AT 4:00 P. Mayor Boineau called to order the Special Meeting of the Town of Snowmass Village on Monday, December 12, 2011 at 4:15 p.m. Item No. 1 ROLL CALL COUNCIL MEMBERS PRESENT: Bill Boineau, John Wilkinson, Jason Haber, Fred Kucker COUNCIL MEMBERS ABSENT: Markey Butler. STAFF PRESENT: PUBLIC PRESENT: Rick Griffin and other members of the public interested in today's agenda items. Item No. 2 PUBLIC NON-AGENDA ITEMS There were no public non-agenda items. Item No. 3 COUNCIL UPDATES SNOWMASS VILLAGE TOWN COUNCIL SPECIAL MEETING MINUTES DECEMBER 12, 2011 Russ Forrest, Town Manager, Hunt Walker, Public Works Director; John Dresser, Town Attorney; Marianne Rakowski, Finance Director; Rhonda Coxon, Town Clerk; Susan Ham ley, Marketing Director Council Member Haber attended a Ruedi Water and Power Authority meeting and noted that the Board is going to refinance all debt for the Ruedi Reservoir. Item No. 4 PUBLIC HEARING 2012 ROAD MILL LEVY FUND Public Works Director Hunt Walker spoke to the Public Hearing Requirements for the Road Mill Levy Fund. This meeting is to receive input when developing the 2012 Road Fund Bid package. Mayor Boineau opened the Public Hearing at 4:16 p.m. There being no Public to comment he then closed the Public Hearing at 4:17 p.m. No action is required by Council. 12 -12 -11 tcsm Minutes Page 2 of 3 Item No. 5 RESOLUTION NO. 28, SERIES OF 2011 LEVYING PROPERTY TAXES FOR THE TOWN OF SNOWMASS VILLAGE Fred Kucker made the motion to approve Resolution No. 28, Series of 2011 levying property taxes for the Town of Snowmass Village. John Wilkinson seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Butler was absent. Voting Aye: Bill Boineau, John Wilkinson, Jason Haber, and Fred Kucker. Voting Nay: None. Rakowski stated Resolution No. 28, Series of 2011 establishes the property tax mill levy for the year 2012. The Pitkin County Assessor's Office provided the Town with the estimated assessed valuation in August for use in the budget process. By December 10 of each year, the County Assessor must recertify the assessed valuation to each entity. By December 15 of each year, the Town must certify the mill levy to Pitkin County. This resolution meets that deadline. The Town is increasing the overall Town mill levy from 7.356 to 8.940 although the amount of property tax collections will be decreasing by $544,683. This is primarily a result of the 26% decrease in the Town's assessed valuation. Attached is a comparison of the mill levies assessed for 2011 and 2012 including a comparison of the property tax per $1 M of market value for both residential and commercial property. Item No. 6 FIRST READING ORDINANCE NO. 6, SERIES OF 2011 MARKETING, GROUP SALES AND SPECIAL EVENTS BOARD Town Attorney John Dresser noted that Council directed staff to prepare an Ordinance amending the Marketing Special Event and Group Sales Board enabling legislations pursuant to the joint meeting the Board on December 7, 2011. The change consists of adding 2 members to the Board, reclassify representation on the Board, create a new Advisory Committee and re- direct Advisory Committee purposes and require approval of the Board's Business Plan. Dresser passed out a revised Ordinance at the meeting, when reviewing he found that he needed to make some minor amendments and add some language by the Marketing Director. Fred Kucker made the motion to approve first reading of Ordinance No. 6, Series of 2011 amending the Marketing, Special Events and Group Sales code language. Jason Haber seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Item No. 7 MANAGER'S REPORT Russ Forrest spoke to a water main break on Brush Creek and he commended the Road Department and Police Department for their quick response and the Water District for finding the main break so quickly. Forrest also noted that the Part Time Residents Board will be before Council on the 19th and Town Clerk Coxon stated that the Citizens Grant Review Board will present the recommendations for grants at the same meeting. Mayor Boineau spoke to some emails that have been sent to date regarding the Town Attorney's contract in regards to the "Powder Clause." Council Member Kucker stated that this should not be discussed until Council Member Butler is present. Council Member Kucker is also not in favor of the clause. It was decided to add the "Powder Clause" in the contract. Jason Haber made the motion to approve the Powder Clause in the Town Attorney's contract. John Wilkinson seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Butler was absent. Voting Aye: Bill Boineau, John Wilkinson, Jason Haber, and Fred Kucker Voting Nay: None.
