02-19-13 Town Council Minutes SNOWMASS VILLAGE REGULAR MEETING MINUTES TUESDAY, FEBRUARY 19, 2013 CALL TO ORDER AT 4:00 P.M. Mayor Boineau called to order the Regular Meeting of the Snowmass Village Town Council on Tuesday, February 19, 2013 at 4:00 p.m. Item No. 1 ROLL CALL COUNCIL MEMBERS PRESENT: Bill Boineau, Jason Haber, Fred Kucker, and Chris Jacobson. COUNCIL MEMBERS ABSENT: Markey Butler. STAFF PRESENT: Russ Forrest, Town Manager, Hunt Walker, Public Works Director; John Dresser, Town Attorney; Rhonda Coxon, Town Clerk; Steve Ferris, Community Development Director; and Brian Olson, Police Sergeant; Susan Hamley, Director of Snowmass Tourism PUBLIC PRESENT: Lenny Oates, Jeff Sivess, Jill Berthard and other members of the Public interested in today's Agenda Item No. 2 PUBLIC NON-AGENDA ITEMS Director of the Little Red Schoolhouse Heather West spoke to the 2013 Citizen Grant Review Board recommendation that was approved by the Town Council at the February 4, 2013 meeting in the amount of $4,000. She stated in the past the Town has covered at least $5,000 to offset the bus service used by the Schoolhouse. She is requesting additional money. Town Clerk Rhonda Coxon will research the history of this request and report back to Council. Item No. 3 COUNCIL UPDATES Mayor Boineau thanked all those involved and affected by Vice President Biden's visit to Snowmass Village over President's weekend. Mayor Boineau attended a RFTA meeting and emailed the packet for all Council Members. 02-19-13tc Minutes Page 2 of 7 Council Member Jacobson attend the Mastodon Exhibit at the Denver Museum and noted is was a fantastic exhibit and any part of that exhibit would be welcomed in Snowmass Village. Council Member Kucker as liaison to the Nordic Council spoke to dog bags and trash receptacles now being located on the Golf Course. Item No. 4 RESOLUTION NO. 15, SERIES OF 2013 - PRE-ANNEXATION AGREEMENT Town Attorney John Dresser spoke to the Pre-Annexation agreement and the purpose of this discussion which is to authorize the Town Manager to execute the Pre- Annexation Agreement. He went on to explain that the Popish Valley is the portion of Wildcat Ranch that was not annexed when the rest of Wildcat was annexed into the Town of Snowmass Village. The owner now desires to include the property in the Town of Snowmass Village and become part of Wildcat Ranch as well. The applicant is Clear W. Ranch LLC. Fred Kucker made the motion to approve Resolution No. 15, Series of 2013 which authorizes the Town Manager to enter into a Pre-Annexation Agreement. Chris Jacobson seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Butler was absent. Voting Aye: Bill Boineau, Jason Haber, Fred Kucker, and Chris Jacobson. Voting Nay: None. The Council would like to look at the Housing Mitigation numbers during the Land Use Code review and understand the formula. There was discussion on the Construction Management Plan and when it would be submitted to the Planning Commission and Town Council. Item No. 5 MOUNTAIN VIEW 11 BUILDING AND SIDEWALK SETTLEMENT REPAIRS Housing Manager Joe Coffey is requesting Council approval to use un-appropriated funds from the Mountain View 11 budget to perform settlement sidewalk repairs. At this time there is $195,723 in Mountain View 11 un-appropriated funds and after receiving several bids it appears $18,000 would cover the project. Jason Haber made the motion to approve spending $18,000 out of the Mountain View 11 un-appropriated reserves to repair sidewalks. Fred Kucker seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Butler was absent. Item No. 6 UPDATE ON TOWN LANDSCAPING PLAN FOR 2013 Town Manager Russ Forrest stated the purpose of this discussion is to update Council on the current plans for landscaping in Town Parks and to provide an historical perspective on how the Real Estate Transfer Tax (RETT) fund has changed since 2008. In the last two years, the Town brought back some funding for trails. However, landscaping has continued to be cut while recognizing some efficiency has been found utilizing contract services. Staff is preparing to issue a RFP for landscaping and would appreciate Council input on whether there are specific areas that should be enhanced recognizing that RETT funding is still very constrained. Town Manager Russ Forrest provided a history of the RETT fund for the last few years. Recreation Director Andy Worline provided history of the Landscaping program including, scope budget and personnel changes from 2008 through 2012. Mayor Boineau and Council Member Butler had asked this item come back before Council to discuss the possibility of enhancing the landscaping at Highway 82 and Brush Creek and the Welcome sign on Brush Creek Road. At this time Council took public comment: Jeff Sivess a resident of Snowmass Village and owner of Drift Busters and Snowmass Lawn and Plant spoke as a concerned citizen about the high amount of dollars that have already been spent building our parks and the investment in landscaping equipment and he noted at this time we have cotton wood trees that locals paid for and helped plant that were moved as part of the Entry Way Master Plan and they are being eaten by beavers and there are blue spruce that are dying due to lack of irrigation through the summer. The gardens have only been maintained for the last couple of years we need someone on staff versus all contract to handle the day to day issues. He stated maybe landscaping should be under the Road Department versus the Recreation Center since they are already out there every day. Mayor Boineau had some concerns in regards to the Recreation Director overseeing the Landscaping department; he stated maybe Landscaping should be in another department. Council Member Haber wants to take care of what we have with no new projects. Council Member Jacobson would like to see a dollar comparison for employee versus contract labor. Council consensus was to have someone to overlook day to day operations of the contracted areas instead of additional recourses to trails and enhancing the status quo. This should be possible by working with the money we have and redistributing the duties. This Item was not on the Agenda. Mayor Boineau asked for a motion to enter into Executive Session: 02-19-13tc Minutes Page 4 of 7 Town Council will now meet in Executive Session pursuant to C.R.S. 24-6- 402(4) and Snowmass Village Municipal Code Section 2-45(c), to specifically discuss one item: a) Conferences with an attorney for the purposes of receiving legal advice on specific legal questions pursuant to C.R.S. 24-6-402(4)(c) and Snowmass Village Municipal Code Section 2-45(c)(2); Provided, there is an affirmative vote of two-thirds of the quorum present at this meeting to hold an Executive Session and for the sole purpose of considering item (a) above. Provided further, that no adoption of any proposed policy, position, resolution, regulation, or formal action shall occur at this Executive Session. At 5:50 p.m. Jason Haber made the motion to enter closed session, Fred Kucker seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Item No. 7 REVIEW PROPOSED USE OF THE HOLY CROSS ENHANCEMENT FUND Town Manager Russ Forrest stated that the Town receives approximately$85,000 a year from the Holy Cross Enhancement Fund. By December of 2013 the Town will have a balance of $729,831. Any use of this fund requires approval of both Holy Cross Electric and the Town Council to use this fund for a specific purpose based on the criteria mentioned below. The purpose of this discussion is to review the opportunities to utilize this fund for the greatest public benefit and provide direction from Council on a plan to utilize this fund. 02-19-13tc Minutes Page 5 of 7 Holy Cross is committed to programs designed to make a difference in people's lives and the communities in which they reside. They will voluntarily make monetary resources available to the Town for such programs and/or activities. Program for which such funds shall be spent shall be limited to 1) Beautification Programs 2) Energy conservation projects 3) Equipment and technology upgrades for schools 4) Scholarship Funds 5) Acquisitions of open space and/or park land and development thereof 6) Sponsorship of special community events 7) Underground of overhead electric and other utilities Staff provided four areas of ideas for the Council to provide direction. He noted one idea came directly from the Council Retreat in regards to a Renewable Energy Project and that presentation will be at the next Council meeting and $500,000 was earmarked for that project. After a lengthy discussion the Council agreed conceptually with the Renewable Energy Project, Trail Signage and Ice Skating but not all were in agreement to the Thursday Night Concerts. The Renewable Energy Project will be discussed at the next Regular Meeting on March 4, 2013. Item No. 8 MANAGER'S REPORT Town Manager Russ Forrest discussed the following items with the Council 1) EOTC Meeting time and date 2) Training for Elected Officials on Incident Command System 3) ATUP for National Brotherhood of Skiing Fireworks and Snowmass Mammoth Festival (Snowmass Chili and Brew Festival) 4) Construction Management Plans 5) Strategic Goals and Actions Item No. 9 AGENDA FOR NEXT TOWN COUNCIL MEETING * March 4, 2013 Town Manager Russ Forrest noted an addition to the agenda may be the "Updated Strategic Plan" and he needs to follow up on some issues for Item No. 5 for the Entry Way discussion. There was a short discussion on future meeting dates. There was a reminder for the Town Council that the April meetings have been changed to April 8th and April 22. Item No. 10 APPROVAL OF MEETING MINUTES FOR Fred Kucker made the motion to approve the minutes for the Regular Meeting of the Snowmass Village Town Council for Monday, September 24, 2012. Jason Haber seconded the motion. The motion was approved by a vote of 3 in favor to 0 opposed. Item No. 11 COUNCIL COMMENTS/COMMITTEE REPORTS/CALENDARS Mayor Boineau attended the event at the Base Village Plaza with our first event under the Entertainment District and everything seemed to run smoothly. There will be a staff debrief in the near future.
