08-05-13 Town Council MinutesSNOWMASS VILLAGE TOWN COUNCIL REGULAR MEETING MINUTES AUGUST 5, 2013 Mayor Boineau called to order the Regular Meeting of the Town of Snowmass Village Town Council on Monday, August 5, 2013 at 4:01 p.m. Item No. 1 ROLL CALL COUNCIL MEMBERS PRESENT: Bill Boineau, Markey Butler, Jason Haber, Fred Kucker, Chris Jacobson, COUNCIL MEMBERS ABSENT: All council members were present. STAFF PRESENT: Russ Forrest, Town Manager, Rhonda B. Coxon, Town Clerk; Marianne Rakowski, Finance Director; John Dresser, Town Attorney; Jim Wahlstrom, Senior Planner; and Steve Ferris, Community Development Director PUBLIC PRESENT: Joe Krabacher, Steve Alldredge, Raul Gawrys, Bart Delorenzo, David Bellack, Jack Donovan, Randy Bennett, Mel Blumenthal, Yanny Nichol, Madeleine Osberger, Patrick Costello, Adam McCabe, Marilyn Cook, Kit Hamby, Matt Lamm, Dwayne Romero, Jill Beathard, Dick Moebius, Shawn Gleason, John Vanghese, Bob Purvis, Bob Sirkus, Gert VanMoorsel, Chad Oliver, Jon Hughes and other members of the public interested in today's Agenda items. Item No. 2 PUBLIC NON - AGENDA ITEMS Raul Gawrys representing the owner of the Hive Building in which the Venga Venga Restaurant is located spoke to the Council about a possible 25 bed Hostel being built in the space under Venga Venga and extending the deck on Venga Venga. Tom Cardamone representing Snowmass Discovery introduced Mack West from 08- 05 -13tc Minutes Page 2 of 6 Informal Learning Experiences and Tim Quaidy who reproduces the mastodons; they are visiting and working with the Tusk group on future endeavors. Lynn Hemley asked that the Council consider allowing some time on a future agenda to discuss a potential dog park in Snowmass Village. Mayor Boineau introduced Gary Suiter as Interim Town Manager and welcomed him. Council Member Jacobson spoke to an application before Pitkin County Planning Commission in regards to building a greenhouse on Cozy point to grow fruits and vegetables. Mayor Boineau stated the Pines Homeowner Association and the Snowmass Fire Protection District performed tree fire load clear cutting mitigation. Boineau is also asking if the rest of the Council and staff would be interested in thinking about a fire clear cutting ordinance. Mayor Boineau and Council Member Butler spoke to the USA Pro Challenge Race coming up on August 19, 2013 and the need for volunteers and the first training is Thursday at CMC at the Airport Business Center. Immune Adam McCabe a member of the Carbondale Rotary and resident of the Valley is the Co- Founder of Purple Star veteran's and families was present and spoke to the need for awareness of the number of veterans that have committed suicide after returning home from war. He asked that Town Council approve Resolution No. 23, 2013, which the Mayor read for the public in support of changing the way our military and country prepares and supports service men and women and their families in their transition to civilian life. This will be accomplished through the creation of a comprehensive homecoming preparedness and decompression training program for veterans, and standardize resources that are readily available to families before welcoming their veteran home. Bill Boineau made the motion to approve Resolution No. 23, Series of 2013 Awareness for returning Veterans. Markey Butler seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Jason Haber, Fred Kucker, Markey Butler, Chris Jacobson, and Bill Boineau. Voting Nay: None. 08- 05 -13tc Minutes Page 3of6 Item No. 5 PUBLIC HEARING - FIRST READING OF ORDINANCE NO, 6, SERIES OF 2013 AN ORDINANCE REGARDING THE BASE VILLAGE BUILDING 13B MINOR PUD AMENDMENT Mayor Boineau opened the Public Hearing to received comments from the Public at 4:34 p.m. Dwayne Romero introduced his team at the table Joe Krabacher, Craig Monzio and additional members of the Colorado and New York office in the audience. At this time he noted he had a 30 minute presentation which also included some discussion on the Modification Draft record of decision for the Base Village construction Management Plan Amendment. At the time the Town Attorney John Dresser asked that the Mayor also open agenda Item No. 6. Mayor Boineau read the title of Item No. 6. At this time Romero provided an entire project overview and proceeded with the amendments, update to PUD agreements and the big picture looking forward. Council Member Kucker and Council Member Butler would like the roundabout be done prior to the CO (Certificate of Occupancy) of building 13B. At this time Dean Gordon and John Baker spoke to the issues facing the Public Works Department and this sparked a lengthy discussion between the Council, staff and applicant. There was also a very lengthy discussion regarding the dissolution of the vesting rights forever or changing the vesting date out for five years. It was decide after hours of discussion to continue the Public Hearing and discussion to the Special Meeting on Monday, August 12, 2013. Staff and Council were not interested in a change of the vesting at this time. The Public Hearing was continued to the next meeting on August 12, 2013. Item No. 6 REFERRAL OF ADMINISTRATIVE MODIFICATION DRAFT RECORD OF DECISION - BASE VILLAGE CONSTRUCTION MANAGEMENT PLAN AMENDMENT This item was discussed within the item above. Ilk d" MIC[I'li Mal: 41M 154100 ADMINISTRATIVE MODIFICATION PROCESSING Community Development Director Steve Ferris spoke to this item and noted that staff, Planning Commission and the Citizen's Committee is seeking Council consideration of four different amendments to the Land Use Code on first reading. He noted two of amendments one seeking to amend the measurement of floor areas and the other seeking to approve the process by which Administrative Modification development plans are managed are the two substantive amendments. There was a lengthy discussion on 08- 05 -13tc Minutes Page 4of6 the process of the "zoning compliance certificate ". This process would encourage compliance and would be a simple procedure, although there may be staff and budget implications. Fred Kucker made the motion to approve first reading as amended of Ordinance No. 4, Series of 2013 amending the Town's Land Use Code. Markey Butler seconded the motion. The motion was approved by a vote of 4 in favor to 1 opposed. Council Member Haber opposed. Voting Aye: Bill Boineau, Markey Butler, Fred Kucker, and Chris Jacobson. Voting Nay: and Jason Haber. Town Manager Gary Suiter provided Council with an update of his schedule to date including meeting with all division and department heads. Then one on one with the department's heads and then he would welcome a one on one with each Council Member. Suiter reviewed upcoming meeting times and dates and reminded Council of the EOTC meeting on August 29, 2013 hosted by the Town of Snowmass Village. Item No. 9 AGENDA FOR NEXT TOWN COUNCIL MEETING • August 12, 2013 • August 19, 2013 There was discussion regarding the Community Survey being moved from the 12th Agenda to the August 19th agenda. Town Attorney Dresser suggested that a discussion item be on agendas prior to the first and second reading of an ordinance. Item No. 10 APPROVAL OF MEETING MINUTES FOR * June 3, 2013 Jason Haber made the motion to approve the meeting minutes for the Regular meeting of the Snowmass Village Town Council on Monday, June 3, 2013. Bill Boineau seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Kucker abstained. Voting Aye: Bill Boineau, Markey Butler, Jason Haber, and Chris Jacobson. Voting Nay: None. Abstained: Fred Kucker. Item No. 11 COUNCIL COMMENTS /COMMITTEE REPORTS /CALENDARS 08- 05 -13tc Minutes Page 5 of 5 Mayor Boineau mentioned a RTFA meeting and a reminder of the "State of the Village" hosted by BJ Adams. Council Member Haber asked that Labor Day be added to the Calendars and informed Council of a Training for IgCC in Carbondale in August. He also noted that NWCCOG is putting on a 'Smart Growth" seminar in Eagle. Haber also attended a RWAPA meeting and will be sponsoring a retreat. Council Member Butler will not be in attendance at the September 23, 2013 meeting. Council Member Jacobson noted he spoke with Gail Schwartz and Millie Hamner and Hamner expressed interest in speaking to Council regarding state and municipal issues. At this time Town Attorney Dresser provided the Council with information regarding Phil McKinney's schedule for meeting with them and member of the public in regard to the Town Manager search. Item No. 12 EXECUTIVE SESSION At 9:00 p.m. Bill Boineau made the motion to adjourn the Regular meeting of the Snowmass Village Town Council on Monday, August 5, 2013. Fred Kucker seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Bill Boineau, Markey Butler, Jason Haber, Fred Kucker, and Chris Jacobson. Voting Nay: None.
