08-12-13 Town Council Minutes SNOWMASS VILLAGE TOWN COUNCIL SPECIAL MEETING MINUTES AUGUST 12, 2013 CALL TO ORDER AT 500 P.M. Mayor Boineau called to order the Special Meeting of the Snowmass Village Town Council on Monday, August 12, 2013 at 5:07 p.m. Item No. 1 ROLL CALL COUNCIL MEMBERS PRESENT: Bill Boineau, Chris Jacobson, Fred Kucker, Markey Butler, and Jason Haber. COUNCIL MEMBERS ABSENT: None STAFF PRESENT: Gary Suiter, Town Manager, Rhonda B. Coxon, Town Clerk; John Dresser, Town Attorney; Jim Wahlstrom, Senior Planner; Sloan Campi, Planner, and Kelly Vaughn, Communications Director PUBLIC PRESENT: Joe Krabacher, Steve Alldredge, David Bellack, Jack Donovan, Randy Bennett, Kit Hamby, Matt Lamm, Dwayne Romero, Jill Beathard, Dean Gordon, Chad Oliver, Jon Hughes, Don Schuster, John Quigley and other members of the public interested in today's Agenda items. Item No. 2 PUBLIC NON-AGENDA ITEMS There were no Public Non-Agenda items. Item No. 3 COUNCIL UPDATES Mayor Boineau and Council Member Butler stated that the USA Pro Challenge Bike race is one week away on August 19, 2013 and he reminded the public that Brush Creek Road will be closed from 12 noon until 4:00 p.m and Jerry Butler is still in need 08-12-13tc Minutes Page 2 of 5 of volunteers. Council Member Jacobson noted that the application for a green house on Cozy Point that he mentioned last Council meeting was approved by the Pitkin Couny P & Z. Council Member Kucker stated that this Sunday is the last concert of the Aspen Music Festival and it should be spectacular. Item No. 4 PUBLIC HEARING - STATE OF THE COMPREHENSIVE PLAN REPORT PER SECTION 16A-1-50 OF THE TOWN'S LAND USE CODE Mayor Boineau opened the Public Hearing to receive comment from the Public at 5:12 p.m. Planner Sloan Campi explained Section 16A-1-50(c) of LUC, that requires review of the Town Comprehensive Plan every 24 months. The Town Comprehensive Plan was adopted in 2010. Community Development Staff has conducted preliminary reviews of applicable Plan chapters with affected departments and lower board support staffs to seek background/supporting information, current status of implementation, proposed updates of existing policies, and possible new policies. This information has been presented to the Planning Commission and recommendations were made on May 30, 2013 in order to develop this "State of the Comprehensive Plan" report as required by the LUC. The Planning Commission presented the Draft State of the Comprehensive Plan Report to the Town Council in a joint meeting on July 1, 2013. Per the Land Use Code Section 16A-1-50(c), this public hearing is taking place forty-five (45) days after the Planning Commission's presentation, on the "State of the Comprehensive Plan." This item will come before Council in the form of and ordinanceTh at a future Council meeting. At 5:40 p.m. Mayor Boineau closed the Public Hearing. Item No. 5 REVIEW DRAFT COMMUNITY SURVEY Communication Director Kelly Vaughn stated the purpose of this presentation is to share a draft of the proposed 2013 Community Survey. She is requesting Council listen to the presentation, and determine if staff is missing any major topics. After a lengthy discussion between staff and Council there was discussion regarding particular questions and Council provided input and suggestions. Vaughn will come back to Council in the near future with suggested changes incorporated within the survey. Item No. 6 EXECUTIVE SESSION 08-12-13tc Minutes Page 3 of 5 Town Council will now meet in Executive Session pursuant to C.R.S. 24-6- 402(4) and Snowmass Village Municipal Code Section 2-45(c), to specifically discuss three items: a) Determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, instructing negotiators pursuant to C.R.S. 24-6-402(4)(e) and Snowmass Village Municipal Code Section 2-45(c)(5); and b) Conferences with an attorney for the purposes of receiving legal advice on specific legal questions pursuant to C.R.S. 24-6- 402(4)(c) and Snowmass Village Municipal Code Section 2- 45(c)(2); c) Personnel matters, except if the employee who is the subject of the session has requested an open meeting, pursuant to C.R.S. 24-6- 402(4)(f)(1) and Snowmass Village Municipal Code Section 2- 45(c)(6); Provided, there is an affirmative vote of two-thirds of the quorum present at this meeting to hold an Executive Session and for the purposes of considering items (a) (b) and (c) above. Provided further, that no adoption of any proposed policy, position, resolution, regulation, or formal action shall occur at this Executive Session. At 6:20 p.m. Bill Boineau, made the motion to enter closed session Chris Jacobson seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Bill Boineau, Chris Jacobson, Markey Butler, Jason Haber, and Fred Kucker. 08-12-13tc Minutes Page 4 of 5 Voting Nay: None Item No. 7 PUBLIC HEARING - FIRST READING OF ORDINANCE NO, 6, SERIES OF 2013 AN ORDINANCE REGARDING THE BASE VILLAGE BUILDING 13B MINOR PUD AMENDMENT 103 Attorney for the applicant Joe Krabacher noted they are seeking Town Council approval for a PUD Amendment to allow a) a change in the unit mix, b) the conversion of a portion (6 parking spaces) of the existing garage on Level 1 into spa usage) and, c) adding four balconies/decks on east and west ends of Building 13B to the 6th level. Also under consideration is a proposed 2nd Restricted Housing Agreement to allow rental of the employee units under a certain rental rate structure. Senior Planner Jim Wahlstrom noted that at the initial Town Council meeting on August 5, 2013, there was discussions between the parties primarily involving options regarding the timing of public improvements (for Wood Road and the roundabout in particular), security, performance bonding/and or restoration bonding within certain time constraints. The applicant submitted an associated but separate Administrative Modification for an updated CMP and Phasing Plan with similar issues. He noted this discussion occurred as a result of the applicants initial memo submitted July 24, 2013 to address timing of public improvements and as a response to Planning Commissions Resolution No. 2, Series of 2013 condition #7b which states: "In consideration of a proposed undated construction management and phasing plan, the Town Council should determine phasing of and security for certain public improvements, such as Wood Road improvements and Brush Creek/Wood Road roundabout, and whether that phasing should be tied to Building 13B." District Manager of the Snowmass Water and Sanitation Kit Hamby was present and provided information regarding the deep utilities. The applicant has taken the vesting request off the table and has agreed to begin the deep utilities and finish Building 13B. The applicant and Town Attorney John Dresser reviewed the updated language for the ordinance. Toni Kronberg a resident of the Roaring Fork Valley provided Council with information regarding a physical therapy pool and asked that Council consider this when the PUD application for Base Village comes before Council. Fred Kucker made the motion to approve first reading of Ordinance No. 6, 2013 - Base Village Building 13B Markey Butler seconded the motion. Item No. 8 REFERRAL OF ADMINISTRATIVE MODIFICATION DRAFT RECORD OF DECISION - BASE VILLAGE CONSTRUCTION MANAGEMENT PLAN AMENDMENT Town Attorney John Dresser reviewed the changes to the Construction Management Plan and Council agreed with the changes. Item No. 9 COUNCIL COMMENTS/COMMITTEE REPORTS/CALENDARS • Council bring your Calendars • Schedule Budget Meetings At this time the Town Attorney John Dresser reviewed Budget Meeting dates with the Council. The all day budget meeting with Council is scheduled for October 9, 2013 beginning at 9:00 a.m., first reading of the revised 2013 will be on October 21 along with the resolution for proposed 2014. Second reading of the revised 2013 will be on November 4, 2013. There will also be a Special Meeting on December 9th, 2013 to set the mill levy. Dresser and the Council also reviewed the Town Manager search dates and set a Council retreat for Tuesday, September 3, 2013 at 1:00 p.m. Item No. 10 ADJOURNMENT At 9:15 p.m. Markey Butler made the motion to adjourn the Special Meeting of the Snowmass Village Town Council on Monday, August 12, 2013.
