Item No. 1: ROLL CALL Item No. 2: EXECUTIVE SESSION: Town Council will now meet in Executive Session pursuant to C.R.S. 24- 6-402(4) and Snowmass Village Municipal Code Section 2-45(c), to specifically discuss two items: a) The purchase, acquisition, lease, transfer or sale of any real, personal, or other property interest pursuant to C.R.S. 24-6- 402(4)(a) and Snowmass Village Municipal Code Section 2-45 c)(1); and b) Determining positions relative to matters that may be subject to negotiations; developing strategy for negotiations; and instructing negotiators, pursuant to C.R.S. 24-6-402(4)(e) and Snowmass Village Municipal Code Section 2-45(c)(5); Provided, there is an affirmative vote of two-thirds of the quorum present at this meeting to hold an Executive Session and for the sole purpose of considering items (a) and (b) above. Provided further, that no adoption of any proposed policy, position, resolution, regulation, or formal action shall occur at this Executive Session. SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 16 SERIES OF 2007 Version 1) A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF SNOWMASS VILLAGE, COLORADO, AUTHORIZING THE TOWN MANAGER AND THE TOWN ATTORNEY TO UNDERTAKE THE ACQUISITION OF CERTAIN REAL PROPERTY IN THE TOWN OF SNOWMASS VILLAGE BY NEGOTIATION OR EMINENT DOMAIN WHEREAS, the Town Council of the Town of Snowmass Village has undertaken to create and construct affordable housing within the Town and to that end has envisioned a new affordable project known as Rodeo Place as part of the Entryway Master Plan; and WHEREAS, the Town Council has undertaken design of affordable housing for the Rodeo Place project and is now desirous of constructing said affordable housing at Rodeo Place: and WHEREAS, the Town Council has determined that a roadway access to the Rodeo Place affordable housing project is necessary and is best located just north of the wetlands that lie to the southwest of the Rodeo Place affordable housing project to connect to the existing public roadway known as Horse Ranch Drive; and WHEREAS, the real property necessary for construction of a public roadway to access the Rodeo Place affordable housing project is owned by the adjacent homeowners association; and WHEREAS, the Town of Snowmass Village, as a Colorado home rule municipality, has the power of eminent domain to acquire real property for public purposes pursuant to Colorado statute; and, WHEREAS, the Town Council of the Town of Snowmass Village has determined it necessary to exercise it's power of eminent domain to acquire certain real property in the Town of Snowmass Village more particularly described as Parcel E, Horse Ranch P.U.D., Town of Snowmass Village according to the recorded plat thereof, County of Pitkin, State of Colorado; and, WHEREAS, the TOSV finds that the adoption of this Resolution is necessary for the immediate preservation of the public health, safety and welfare. NOW THEREFORE BE IT RESOLVED, by the Town Council of the Town of Snowmass Village, Colorado: 07-16 RESO. Page 2 of 2 1. That the Town Manager together with the Town Attorney are hereby authorized acquire the real property described as Parcel E, Horse Ranch P.U.D. Town of Snowmass Village according to the recorded plat thereof, County of Pitkin, State of Colorado for public purposes by negotiation with the owner of said real property or by exercise of the power of eminent domain.
