PUBLIC HEARINGS QUASI- JUDICIAL HEARINGS Public Hearings are the formal opportunity for the Town Council to LISTEN to the public regarding the issue at hand. For land use hearings the Council is required to act in a quasi - judicial capacity. When acting as a quasi - judicial body, the Council is acting in much the same capacity as a judge would act in a court of law. Under these circumstances, the judicial or quasi - judicial must limit its consideration to matters which are places into evidence and are part of the public record. The Council must base their decision on the law and the evidence presented at the hearing. • Staff Presentation. Core Issues: EPS is a land economics consulting firm experienced in the full spectrum of services related to real estate development market analysis, public /private partnerships, and the financing of government services and public infrastructure. The company has been retained by the Town of Snowmass Village to review the fiscal impact analysis that is required to be submitted as part of the Preliminary Plan application and review of the Base Village PUD amendment submitted by the Snowmass Acquisition Company. Andrew Knudtsen and Tim Morzel of Economic Planning Systems (EPS) will make the PowerPoint presentation to Town Council. This presentation, requested by Town Council in early June of this year, is intended as an education session that will introduce in more detail the trends related to new resort "products" including timeshare /fractional units and vacation clubs, post- recession. Although this presentation on trends and new resort products will provide background information for the resort as a whole as well as the Base Village proposed PUD amendment, EPS will not specifically be addressing that application, but rather will compare and contrast Snowmass with other Colorado and National resorts so that the community as a whole will better understand the Snowmass market position and how the community can keep pace with trends. As the community begins the sketch plan review of the Base Village PUD amendment and any other land use concepts or applications, understanding the market, products, amenities and seasonality of competing resort communities will better inform the decision - makers as they work with applicants towards improved projects that will best serve both residents and visitors. Staff has invited the Town's Planning Commission, Marketing Board, Financial Advisory Board and the Marketing and Special Events Staff to attend, as well as Staff from Related. PURPOSE AND ACTIONS REQUESTED OF COUNCIL: Staff requests Council's approval of the Federal Transit Administration's Master Agreement which includes in Appendix A the list of Certifications and Assurances that are requirements to accept 5339 (Capital) and 5311 (Administration, Operating and Capital) grants from the Federal Transit Administration (FTA). Resolution #40, Series of 2014 accepts the terms of the Federal Master Agreement for 2015 grant funding for our projects, and authorizes the Transportation Director to certify the affirmation of the annual Certifications and Assurances for these projects. The Town has been approving the Master Agreement over the last nine years. BACKGROUND: This resolution approves the Town accepting financial assistance from the FTA for the purchase of transit vehicles (under Section 5339), and acceptance of Administration and Operating assistance (under Section 5311) through FTA grants in federal fiscal year 2015. The grant's Master Agreement contains a number of Certifications and Assurances that apply to the use of Federal funding for the specified grant's purpose. The Certifications and Assurances cover a number of issues, most notably: 1. Authority and Ability to Enter Into an Agreement with the FTA; and 2. Lobbying Compliance; and 3. Procurement Compliance; and 4. Safety and Asset Management Plans; and 5. Protections for Private Transportation Providers; and 6. Public Hearing; and 7. Acquisition of Rolling Stock Guidelines; and 8. Charter Service Agreement; and 9. School Transportation Agreement; and 10. Americans With Disabilities Act; and 11. Alcohol Misuse and Prohibited Drug Use; and 12. Title VI Civil Rights Act; and 13. Labor Standards. In the summer of 2014, Snowmass Discovery engaged the services of Amaze Design and other partners to conduct a feasibility study for Snowmass Discovery with the goal of determining the size, capital costs, operating pro -forma and other attributes of a visitor attraction associated with Snowmass Discovery. Snowmass Discovery presented the results of this feasibility study to the Town Council on September 22, 2014; that study is attached for review. At that meeting, Snowmass Discovery indicated their next step would likely be to engage a consultant to help determine the feasibility of raising the necessary funds for the capital construction and the required endowment for the operations of the facility. To that end, Snowmass Discovery has interviewed a number of firms that provide this service and is close to entering into a contract with one. The cost estimates for the analysis ranged from $20,000 to $50,000. Snowmass Discovery is estimating the cost to be $30,000. At the end of the analysis, Snowmass Discovery will have a stronger understanding of the philanthropic fund raising potential of this project. With that potential better understood, Snowmass Discovery will know what size facility can likely be afforded to construct and what size endowment will need to be raised to cover the annual operating deficit. Snowmass Discovery is requesting this $15,000 to go toward the funding of the feasibility analysis. It would be incumbent on Snowmass Discovery to raise the remaining dollars to undertake this endeavor. Since 2011 TOSV has contributed over $55,000 from the General Fund to Snowmass Discovery and their ongoing efforts. In addition, since 2011 TOSV has spent approximately $225,000 operating the Ice Age Discovery Center on the Mall (not including payroll costs). A summary of those expenses is attached. Financial Impact: Snowmass Discovery is requesting $15,000 for the funding of the feasibility analysis. The total cost of the analysis is expected to be approximately $30,000. The $15,000 of requested funds is not budgeted in either the 2014 or the 2015 Budget. Should the Council desire to provide this funding the 12 -15 -14 TC Packet 20 12 -15 -14 TC Packet 21 best source of funds would likely be from Fund Balance (savings account). An additional appropriation such as this requires an ordinance process. Such a process is currently scheduled to occur in February. This appropriation could be accommodated at that time. Council Options: The Council has a variety options available to them. One of the more difficult aspects of the request is that even with the analysis competed there still won't be funds raised yet for the Snowmass Discovery project, the Town will still be making a sizeable annual allocation toward operating the Ice Age Discovery Center and there is not a defined strategy for the next steps following the analysis. Staff It is the recommendation of the Snowmass Village Staff that the Council Recommendation: direct staff to process this requested additional appropriation in February with an ordinance. It is recommended that TOSV's contribution be used as matching funds for this study and that TOSV dollars be released only once the remaining dollars necessary for the analysis are raised.
