CALL TO ORDER AND ROLL CALL Mayor Pro Tem Sirkus called to order the Regular Meeting of the Snowmass Village Town Council on Monday, April 6th, 2015, at 4:02 p.m. A complete live recording of this meeting can be found at www.tosv.com under Town Council Meetings. PROCLAMATIONS AND PRESENTATIONS A. PROCLAMATION • OF SUPPORTOF r UP FOR TRANSPORTATION DA Mayor Pro Tem Sirkus read the Mayor's Proclamation No. 01, Series of 2015 in Support of Stand up for Transportation Day and presented to the Town of Snowmass Village Transit Director. PUBLIC COMMENT This section is set aside for the Town Council to LISTEN to comment by the public regarding items that do not otherwise appear on this agenda. Generally, the Town Council will not discuss the issue and will not take an official action under this section of the agenda. No Public Comment at this time. 4. CONSENT AGENDA These are items where all conditions or requirements have been agreed to or met prior to the time they come before the Council for final action. A Single Public Hearing will be opened for all items on the Consent Agenda. These items will be approved by a single motion of the Council. The Mayor will ask if there is anyone present who has objection to such procedure as to certain items. Members of the Council may also ask that an item be removed from the consent section and fully discussed. All items not removed from the consent section will then be approved. A member of the Council may vote no on specific items without asking that they be removed from the consent section for full discussion. Any item that is removed from the consent agenda will be placed on the regular agenda. A. RESOLUTION NO. 16, SERIES OF 2015 - A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF SNOWMASS VILLAGE, COLORADO APPROVING A REVISION TO THE 2015 BUDGET FOR THE PITKIN COUNTY '/z CENT TRANSIT SALES AND USE TAX D. FINALIZE CITIZEN SURVEY The Town Council asked to discuss the citizen survey prior to voting on the Consent Agenda. Council reviewed with staff and made language changes. Mayor Butler also discussed the May 7th Work Session and asked if the time could be changed to 8:30 a.m. consensus was to start the Work Session at 8:30 a.m. 04-06-15 tc Minutes Page 3 of 5 Bob Sirkus made the motion to approve as amended by the Council the above items listed on today's consent agenda. Bill Madsen seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Markey Butler, Bob Sirkus, Chris Jacobson, Bill Madsen and Alyssa Shenk Voting Nay: None. 5. POLICY/LEGISLATIVE PUBLIC HEARINGS A. SECOND READING - ORDINANCE NO. 03, SERIES OF 2015 - AN ORDINANCE AMENDING THE 2015 BUDGET FOR THE GENERAL FUND, REAL ESTATE TRANSFER TAX FUND, ROAD FUND, AND THE MARKETING/SPECIAL EVENTS FUND FOR THE TOWN OF SNOWMASS VILLAGE Finance Director Rakowski stated this is the second reading of Ordinance No. 3, Series of 2015 approving an ordinance amending the 2015 budget for the General Fund, Real Estate Transfer Tax Fund, Road Fund, and the Marketing, Group Sales and Special Events Fund. She reviewed the revisions and provided back up for each one. Chris Jacobson made the motion to approve with a Roll Call vote of the Town Council for second reading of Ordinance No. 3, Series of 2015 - amending various funds of the 2015 budget. Bill Madsen seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Markey Butler, Bob Sirkus, Chris Jacobson, Bill Madsen and Alyssa Shenk Voting Nay: None. 6. PUBLIC HEARINGS QUASI-JUDICIAL HEARINGS Public Hearings are the formal opportunity for the Town Council to LISTEN to the public regarding the issue at hand. For land use hearings the Council is required to act in a quasi-judicial capacity. When acting.as a quasi-judicial body, the Council is acting in much the same capacity as a judge would act in a court of law. Under these circumstances, the judicial or quasi-judicial must limit its consideration to matters which are places into evidence and are part of the public record. The Council must base their decision on the law and the evidence presented at the hearing. A. PUBLIC HEARING Base Village Major PUD Amendment - Sketch Plan Review --Julie Ann Woods, Director, Community Development --Jim Wahlstrom, Senior Planner, Community Development 04-06-15 tc Minutes Page 4 of 5 Community Development Director Julie Ann wood spoke that this is a continued Public Hearing from March 16th and at the request of the applicant the Public Hearing was continued to tonight's meeting. At this time she highlighted the revisions from the prior meeting and they are also listed in the letter from the applicant in the packet dated April 1, 2015 on page 73 of Today's packet. The Town Council will determine if the application should move forward into Preliminary Plan stage subject to the applicant adequately responding to the concerns put forward in the referral agency comments in efforts to address the code's review criteria. Additionally, it should be subject to the applicant being able to adequately address the ten major cores issues provided within the packet today from the Planning Commission Resolution No 03, Series of 2015. At this time the applicant representative Craig Munzio thanked staff for many hours of work, and he asked that the roundabout be pulled as a separate application and provided the reasoning. Mayor Butler asked this be discussed later in this presentation. Continued the Public Hearing and then opened for Public Comment: Toni Kronberg spoke to the Aquatic Center being removed and a small pool being private for the Limelight Hotel, she feels we need a full aquatic center. Kronberg also spoke to a people mover between Base Village and the Town Center for easy access to the Snowmass Recreation Center. At this time Mayor Butler asked that the applicant discuss the current plans for the Plaza area, community purpose and cash in lieu options. This was a very lengthy discussion between the Council and the applicant. The applicant agreed to an ice rink and some type of summer water feature for the 2 million dollars allocated for the aqua center to keep the vitality in Base Village and then 3.5 million dollars for Community Purpose which the Town will decide on. The applicant asked for a short break at this time. After the break the applicant offered the Town Council 5.5 million with a request of additional 40,000 square feet of additional density for 1 million. Clint Kinney, Town Manager recapped the proposal and noted that this information can be incorporated within a Resolution to be presented at the next Town Council Meeting for consideration by the Council and applicant to review the items discussed today. At this time the Council continued the discussion with the applicant in regards to separating the Wood Road, Brush Creek round -a -bout discussion from the Sketch Plan Review for Base Village Major PUD Amendment. The applicant is continuing collaboration with the Conoco owners and design team. This will be a definite discussion before Council on the May 4, 2015 meeting. 04-06-15 tc Minutes Page 5 of 5 Mayor Butler continued the Public Hearing to April 13, 2015 Town Council Special Meeting at 4:00 p.m. 7. ADMINISTRATIVE REPORTS No reports for this meeting. A. REPORTS/UPDATES Mayor Butler stated she attend the first meeting of the Public Health Board. Council Member Jacobson noted that the Ice Rink is going to need some in depth discussion for next year. 9. ADJOURNMENT Bob Sirkus made the motion to adjourn the Regular Meeting of the Snowmass Village Town Council for Monday, April 6, 2015. Chris Jacobson seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Markey Butler, Bob Sirkus, Chris Jacobson, Bill Madsen, and Alyssa Shenk. Voting Nay: None.
