04-20-15 Town Council MinutesSNOWMASS VILLAGE TOWN COUNCIL REGULAR MEETING MINUTES APRIL 20, 2015 1. 400 P.M. CALL TO ORDER AND ROLL CALL Mayor Butler called to order the Regular Meeting of the Snowmass Village Town Council on Monday, April 20th, 2015, at 4:04 p.m. A complete live recording of this meeting can be found at www.tosv.com under Town Council Meetings. COUNCIL MEMBERS Markey Butler, Chris Jacobson, Bob Sirkus, Bill Madsen and PRESENT: Alyssa Shenk COUNCIL MEMBERS All council members were present. ABSENT: STAFF PRESENT: Clint Kinney, Town Manager; Marianne Rakowski, Finance Director; Fred Brodsky, Group Sales Manager; John Dresser, Town Attorney; Joe Coffey, Housing Director; Rhonda B. Coxon, Town Clerk PUBLIC PRESENT: Jill Beathard 2. PROCLAMATIONS AND PRESENTATIONS None at this time. 3. PUBLIC COMMENT This section is set aside for the Town Council to LISTEN to comment by the public regarding items that do not otherwise appear on this agenda. Generally, the Town Council will not discuss the issue and will not take an official action under this section of the agenda. None at this time. 4. CONSENT AGENDA These are items where all conditions or requirements have been agreed to or met prior to the time they come before the Council for final action. A Single Public Hearing will be opened for all items on the Consent Agenda. These items will be approved by a single motion of the Council. The Mayor will ask if there is anyone present who has objection to such procedure as to certain items. Members of the Council may also ask that an item be removed from the consent section and fully discussed. All items not removed from the consent section will then be approved. A member of the Council may vote no on specific items without asking that they be 04-20-15 tc Minutes Page 2 of 4 removed from the consent section for full discussion. Any item that is removed from the consent agenda will be placed on the regular agenda. A. REVIEW DRAFT AGENDAS FOR * May 4, 2015 - Regular Meeting * May 7, 2015 - Work Session * May 18, 2015 - Regular Meeting B. REVIEW OF CALENDARS: May June July C. APPROVAL OF MINUTES March 2, 2015 - Regular Minutes Chris Jacobson made the motion to approve those items listed on today's consent agenda. Bob Sirkus seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Markey Butler, Chris Jacobson, Bill Madsen, Bob Sirkus and Alyssa Shenk Voting Nay: None. Mayor Butler stated that she will be out of Town for the June 15th meeting and so is Council Member Sirkus. A temporary Mayor Pro Tem will be appointed for that meeting. The Mayor inquired as to some of the items listed on the future agendas. She also asked how "Community" will weigh in on the "Community Purpose" item; Town Manager reviewed the process which would be during the Public Hearing process and public comments for the record, by email or written to the Town. 5. PUBLIC HEARINGS QUASI-JUDICIAL HEARINGS Public Hearings are the formal opportunity for the Town Council to LISTEN to the public regarding the issue at hand. For land use hearings the Council is required to act in a quasi-judicial capacity. When acting as a quasi-judicial body, the Council is acting in much the same capacity as a judge would act in a court of law. Under these circumstances, the judicial or quasi-judicial must limit its consideration to matters which are places into evidence and are part of the public record. The Council must base their decision on the law and the evidence presented at the hearing. None at this time. 6. POLICY/LEGISLATIVE PUBLIC HEARINGS No Hearings 04-20-15 tc Minutes Page 3 of 4 A. Review of GID and Metro District Responsibilities --John Dresser Town Attorney John Dresser provided a presentation that explained the formation of a General Improvement District and Metro District, he provided the projects to be funded through the districts and a draft GID and Metro District financing scenario. Dresser provided all the documents for the Council that formulated the districts and the Base Village Intergovernmental Agreement. Council and staff discussed the information. He noted that in an effort to keep the presentation comprehensive as possible the most important portion of the lengthy packet information is the first 11 pages within the packet. B. Design Review Consistency for Single Family Homes --Julie Ann Woods Community Development Director Julie Ann Woods stated that after a particular "modern home" was built in Sinclair Meadows which staff received some complaints from residents expressing concerns about its mass, scale, context, breaking the "ridgeline", etc. In response to the complaints and direction from the Town Manager Clint Kinney, staff drafted a memo about the design review process which Council received in December. She noted that Council has since then requested a work session to further discuss the issue of design review with staff. She explained the different review standards for Sinclair Meadows compared to the Town review standards. Council member Sirkus asked that staff provide Council with a copy of Sinclair Meadows review standards. The Council would like to stay away from subdivisions having their own review standards but to continue with Town wide consistency for all homeowners associations. C. Review Analysis on the potential ice rink shade structure and update on the overall cost of the ice rink --Andy Worline Parks and Recreation Director Andy Worline spoke to the timeline of the Ice Rink this past year. He noted the 2014-2015 season for the ice rink was over almost as fast as it started. Council Member Madsen stated the biggest part of the entire rink is the maintenance throughout the season. Worline will continue possible future partnership with Snowmass Wildcat Fire Department for help with the initial flooding and set-up of the rink. Town Manager Clint Kinney noted that at this time staff is prepared to provide the same scenario as last year as long as the Council is in agreement to the level of service as in the past. The Council consensus was to continue as it was last year, and he is in total agreement with the Council that a long range plan needs to be worked on for infrastructure and staffing. Worline will have the proposed numbers in the budget for October. 04-20-15 tc Minutes Page 4 of 4 8. TOWN COUNCIL REPORTS AND ACTIONS A. REPORTS/UPDATES Council Member Sirkus asked that the Financial Advisory Board meet and prepare a report, and do a study on the Town Sales Tax structure and determine if the Town can reallocate any sales tax dollars and provide the Town Council with a recommendation for the Aspen School District request. This will be discussed at a Work Session on June 22, 2015. The June 8, 2015 Work Session will be cancelled. Council Member Madsen and the Town Manager Clint Kinney toured the Viceroy for the Water and Sanitation department regarding the drainage. Bill Madsen made the motion to adjourn the Regular Meeting of the Snowmass Village Town Council on Monday, April 20th, 2015. Alyssa Shenk seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Markey Butler, Alyssa Shenk, Chris Jacobson, Bill Madsen and Bob Sirkus. Voting Nay: None.
