07-06-15 Town Council Minutes SNOWMASS VILLAGE TOWN COUNCIL REGULAR MEETING MINUTES JULY 6,2015 1.400 P.M.CALL TO ORDER AND ROLL CALL Mayor Butler called to order the Regular Meeting of the Snowmass Village Town Council on Monday,July 6,2015 at 4:02 p.m. A complete live recording of this meeting can be found at www.tosv.com under Town Council Meetings.This will be archived indefinitely allowing you to view at any time. COUNCIL MEMBERS Markey Butler,Chris Jacobson,Bob Sirkus,and Bill Madsen PRESENT: COUNCIL MEMBERS Alyssa Shenk ABSENT: STAFF PRESENT: Clint Kinney,Town Manager;John Dresser,Town Attorney; Travis Elliott,Asst.to Town Manager;Julie Ann Woods, Community Development Director;Chase Anderson,Planner; Rhonda B.Coxon,Town Clerk PUBLIC PRESENT: Madeleine Osberger,Wendy Monzio,Tom Goode,Doug Faurer, Mel Blumenthal,Gert Von Moorsel,Steve Alldredge,Jill Beathard,Ricki Newman and other members of the public interested in today's Agenda items. 2.PROCLAMATIONS AND PRESENTATIONS None at this time. 3.PUBLIC COMMENT This section is set aside for the Town Council to LISTEN to comment by the public regarding items that do not otherwise appear on this agenda. Generally,the Town Council will not discuss the issue and will not take an official action under this section of the agenda. None at this time. 4.CONSENT AGENDA These are items where all conditions or requirements have been agreed to or met prior to the time they come before the Council for final action.A Single Public Hearing will be opened for all items on the Consent Agenda.These items will be approved by a single motion of the Council.The Mayor will ask if there is anyone present who has objection to such procedure as to certain items.Members of the Council may also ask that an item be removed from the consent section and fully 07-06-15tc Minutes Page 2 of 5 discussed. All items not removed from the consent section will then be approved. A member of the Council may vote no on specific items without asking that they be removed from the consent section for full discussion. Bob Sirkus, Council Member seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Shenk was absent. PUBLIC HEARINGS QUASI-JUDICIAL HEARINGS Public Hearings are the formal opportunity for the Town Council to LISTEN to the public regarding the issue at hand. For land use hearings the Council is required to act in a quasi-judicial capacity. When acting as a quasi-judicial body, the Council is acting in much the same capacity as a judge would act in a court of law. Under these circumstances, the judicial or quasi-judicial must limit its consideration to matters which are places into evidence and are part of the public record. The Council must base their decision on the law and the evidence presented at the hearing. None at this time. 6. POLICY/LEGISLATIVE PUBLIC HEARINGS No Hearings Scheduled 7. ADMINISTRATIVE REPORTS A. RESOLUTION NO. 22, SERIES OF 2015 - A RESOLUTION CONCERNING DEFERRAL OF CERTAIN PRELIMINARY PLAN REQUIREMENTS FOR A MAJOR PUD AMENDMENT REGARDING BASE VILLAGE --Julie Ann Woods, Community Development Director 07-06-15tc Minutes Page 3 of 5 Community Development Director Julie Ann Woods stated that on May 29, 2015 the applicant, Snowmass Acquisition Company, LLC, (SAC) submitted the Preliminary Plan for the Major PUD Amendment to the Base Village PUD, pursuant to the Land Use Code. SAC is requesting that the Planning Director accept computer-generated three- dimensional or other visual imagery in place of the required block model and a deferral request to Town Council to allow the submittal of the Homeowner's or condominium association documents at the Final PUD stage. She stated that she has determined that computerized visual imagery would better serve the review process and is in favor of waiving the 3-D block model requirement. Bob Sirkus, Council Member made the motion to approve Resolution No. 22, Series of 2015, approving deferral of certain preliminary plan requirements for a major PUD amendment regarding Base Village. Bill Madsen, Council Member seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Shenk was absent. RESOLUTION NO. 23, SERIES OF 2015 - A RESOLUTION PROVIDING TOWN COUNCIL DIRECTION IDENTIFYING SPECIFIC COMPONENTS OR PROJECT ELEMENTS, AREAS OF THE CODE OR CORE ISSUES FOR THE PLANNING COMMISSION'S REVIEW OF THE MAJOR PUD AMENDMENT PRELIMINARY PLAN APPLICATION INVOLVING BASE VILLAGE --Julie Ann Woods, Community Development Director Community Development Director Julie Ann Woods stated that at a Joint Planning Commission/Town Council meeting on June 24, 2015 Snowmass Acquisition Company (SAC) made a presentation of the Base Village Preliminary PUD land use application. At that meeting, the Town Council discussed core issues and identified review items regarding the application upon which the Town Council desires detailed recommendations from the Planning Commission. The Town Council asked that staff list the issues by priority within the resolution as they relayed them to staff. Chris Jacobson made the motion to approve Resolution No. 23, Series as amended by Town Council identifying specific components and elements, and areas of the code or core issues for the Planning Commission review. Bob Sirkus seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Shenk was absent. FIRST READING - ORDINANCE NO. 06, SERIES OF 2015 - AN ORDINANCE AMENDING CERTAIN PROVISIONS OF CHAPTER 16A OF THE SNOWMASS MUNICIPAL CODE RELATED TO SPECIAL EVENTS AND TEMPORARY USE PERMITS AS WELL AS ENCROACHMENTS OF ROOF OVERHANGS AND THE PROCESSING OF SUCH THROUGH THE ADMINISTRATIVE MODIFICATION PROCESS --Chase Anderson, Planner Planner Chase Anderson noted that this ordinance amends the code to provide a streamlined process and permitting for special events and to allow restricted roof overhangs into the setback or outside of the building envelope. There is also a third minor amendment clarifies the definition of grade. Bob Sirkus made the motion to approve the first reading of Ordinance No. 6, Series of 2015, amending certain portions of Chapter 16A of the Snowmass Village Municipal Code. Bill Madsen seconded the motion. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Shenk was absent. Discussion of process for Krabloonik Best Practices Review Committee --Clint Kinney Town Manager Clint Kinney noted that early this year the Town entered into a lease agreement with Krabloonik and Section 10 of the amended lease requires that a Best Practice Review Committee be created to inspect and review the operations of Krabloonik Kennels to determine the extent to which the tenant is complying with the best practices in the lease. The discussion today is for Council to provide staff with direction to move forward in advertising or appoint three members for this committee. Krabloonik will also appoint three for a total of a six person board. Kinney also noted that staff is working to develop a set of proposed by-laws for the future committee to consider adopting. Council directed staff to advertise and have applicants come before Council for interview and appointment. Council asked that the applicants have experience with working dogs and treatment of dogs, possibly a local veterinarian and/or someone from the Aspen Animal Shelter. 8. TOWN COUNCIL REPORTS AND ACTIONS A. REPORTS/UPDATES Council Member Madsen noted it was great to see the Village busy with Wanderlust. Mayor Butler agreed and enjoyed the vendors and seeing the Mall busy. Council Member Sirkus enjoy the vibrancy also and would like to see more of this vitality versus the events at the Town Park. 07-06-15tc Minutes Page 5 of 5 Mayor Butler attended a RFTA meeting and has a Public Health Board meeting coming up. 9. ADJOURNMENT Bill Madsen made the motion to adjourn the Regular Meeting of the Snowmass Village Town Council on Monday, July 6, 2015, seconded by Bob Sirkus The motion was approved by a vote of 4 in favor to 0 opposed.
