Town Council Resolution 84 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 84 SERIES OF 1983 A RESOLUTION APPROVING AN AGREEMENT FOR TAXI SERVICE. WHEREAS, the Town is currently providing transportation services to the residents and guests of Snowmass VIllage through its inter -municipality bus system; and WHEREAS, the Town Council desires to supplement such system on a basis with demand tax service; and NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: CAS+inn nna That the Taxi Service Agreement attached hereto and made a part hereof as Exhibit A, is hereby approved and the Mayor is authorized to execute same on behalf of the Town. INTRODUCED, READ AND ADOPTED by the Town Council of the Town of Snowmass Village, Colorado, on the day of December, 1983, by a vote of to Adoption Failed on December 19, 1983 by a vote of 2 in favor, 4 opposed, Francis, Johnson, Tippett and Wall. By: ATTEST: Jefferson Tippett, Mayor Susan Garrison, Town Clerk TAXI SERVICE AGREEMENT This agreement is entered into this day of December, 1983, by and between High Mountain Taxi Company (Company and the Town of Snowmass Village, Colorado (Town). In consideration of the mutual promises and obligations of the parties set forth herein, the Company agrees to provide taxi service to residents and tourists visiting Snowmass Village on a demand basis in accordance with the following terms and conditions: 1. Area To Be Served A. Woodrun Subdivision excluding the Crestwood, Woodrun V and Woodrun Place Condominiums. B. Ridgerun Subdivision including the Ridge Condominiums. C. Country Club Subdivision including Fairway Drive Homes but excluding the Snowmass Club and Villas North Apartments. D. Melton Ranch Subdivision excluding those parts of Melton Ranch within one quarter mile of the bus routes. E. The Snowmass Medical Clinic F. Krabloonik Kennels 2. Fares The Town and the Company agree that the purpose of this Agreement is to establish a taxi service system at reduced costs to passengers which serves those parts of Snowmass Village beyond the Town's free shuttle routes. Unless a customer presents a valid taxi service voucher (Voucher) to a Company employee operating a Company cab, the fare to be charged to and paid by any such customer will be the meter rate authorized by the Company's P.U.C. tariff. Presentation of a voucher shall entitle the customer to one-way service between points in Snowmass Village within the service area described in paragraph 1 above. The Town shall honor vouchers upon presentation by paying the Company $3 plus the amount of the actual meter rate in excess of $3 as shown on said voucher. Unused vouchers may be redeemed at any time for a refund of the $3.00 fee paid for such voucher. Only those vouchers printed and distributed by the Town, with sequential numbers, will be honored for payment, provided that each voucher contain the following information: A. Customer signature B. Meter reading C. Date E. Pickup and drop off points 1 The Town shall be responsible for the sale and distribution of vouchers at the Town offices and such other locations as may be designated from time to time by the Snowmass Village Transportation Department Director. The parties understand that the Town's responsibility to pay the amount of actual meter reading in excess of $3 is limited to an aggregate of $5,000 less costs incurred by the Town for printing and advertising in conjunction with this Agreement. At such time as the maximum expenditure is reached, this Agreement shall automatically terminate. The Town shall use its best efforts to notify the Company in advance of reaching the $5,000 level so that the Company can prepare for termination of the Agreement. 3. Hours of Service The taxi service described herein will be available from 8:00 a.m. to 10:30 p.m. seven days per week during the term of this Agreement. 4. Response Time The system will be activated by the person or persons desiring service calling a phone number designated by the Company. Every effort will be made by the Company to keep the response time as low as possible but it is understood that in no event shall response time exceed twenty minutes. 5. Insurance It is agreed that at all times during the course of this contract, the Company will have in full force and effect a $5,000,000 liability insurance policy naming the Town as an additional insured. The policy will be in a form and of a substance acceptable to the Town. Proof of such insurance will be provided to the Town within ten days of the execution of this Agreement. 6. Term The service described herein will commence on the day of December, 1983, and end on the twelfth day of April, 1984, unless automatically terminated as provided in paragraph 2 above or unless terminated by either party, for any reason, upon one week's written notice. 7. Penalty In the event that the Company or any employee thereof shall submit any falsified vouchers for payment or in any way abuse the system described herein, the Company shall be subject to a penalty of $100 per occasion.
