Town Council Resolution 80 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 80 SERIES OF 1983 A RESOLUTION APPROVING A SUBDIVISION EXEMPTION APPLICATION FOR A PLAYGROUND. WHEREAS, the Snowmass Community Fund, as developer, and the Snowmass Company, Ltd., as landowner, have requested a subdivision exemption for a playground described in attached Exhibit A; and WHEREAS, the Town Council previously approved a special review use permit for the playground in Resolution No. 78, Series of 1983; and WHEREAS, the Planning Commission recommended approval of the subdivision exemption request in Resolution No. 19, Series of 1983; and WHEREAS, The Snowmass Company, Ltd. intends to convey the parcel to the Town for public land dedication pursuant to Ordinance No. 17, Series of 1978; and WHEREAS, a public hearing was held on November 2.1, 1983 to receive public comment on the proposed subdivision exemption. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One. Findings 1. Such subdivision of land for park and recreation purposes where there are no new road or main utility line extensions does not fall within the intent and purpose of the definition of a subdivision. 2. The application is consistent with the preservation of the goals, objectives and standards of the land area involved. 3. The application does not affect in a substantially adverse manner either the enjoyment of land abutting upon or across the street from the property in question or the public interest. Section Two. Approval The Town Council hereby approves the subdivision exemption for the playground.
