Town Council Resolution 77 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 77 SERIES OF 1983 A RESOLUTION GRANTING CONDITIONAL APPROVAL FOR THE ASPEN SKIING COMPANY'S STAGE ONE S.P.A. PLAN SUBMISSION OF THE REVISED MASTER DEVELOPMENT PROGRAM FOR THE MT. BALDY PORTION OF THE SNOWMASS SKI AREA. WHEREAS, the Aspen Skiing Company (the Applicant) has submitted an application for approval of a Stage One (Conceptual) S.P.A. plan for a project hereinafter known as the "Revised Master Development Program" applicable to the Western phase of the Snowmass Ski Area; and WHEREAS, the Town Council and the Planning Commission participated in the joint presentation of this submission by the Applicant on September 6, 1983; Mm I WHEREAS, the Planning Commission submitted its finding and recommendations to the Town Council on the 17th day of October, 1983, in accordance with the provisions of the Land Use Code as more particularly set forth in Planning Commission Resolution No. 15, Series of 1983; and WHEREAS, the Town Council has reviewed the initial submission and the findings and recommendations of the Planning Commission and on the basis of such review, together with the comments of the public, the Applicant, and staff, the Town Council desires to approve the "Revised Master Development Program" Stage One S.P.A. submission subject to the findings and conditions set forth below. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado. Section One. Findings 1. Based on the information contained in the record of proceedings in this matter to date, the Town Council finds that the "Revised Master Development Program" Stage One S.P.A. submission is consistent with the provisions of the Town's Master Plan and that the land areas contained in the submission are suitable for continued ski area development pending further information to be provided in the Stage II submission, and the conditions contained in Section Two. 2. That the Applicant has complied with the submission data and procedural requirements of the Land Use Code as they relate to Stage One S.P.A. plan submissions. Section Two. Conditional Approval Subject to compliance with the conditions set forth below, the Revised Master Development Program Stage One S.P.A. submission as described in Exhibit B, is hereby approved. 1. It is the Council's opinion that the 10,000 S.A.O.T. figure is adequate for capacity planning purposes at this time. Regardless of the figure for capacity which the Town ultimately considers appropriate, there should be reasonable assurances that appropriate action(s) will be taken to mitigate any adverse impacts which may result if the 10,000 S.A.O.T. capacity figure is exceeded on a continuing basis. It is therefore recommended that this topic be further explored through an annual presentation of the previous year's Ski Area operation. 2. The Town Staff and the Applicant shall jointly develop a comprehensive transportation plan for consideration by the Town Council as Stage II. The plan's primary focus shall be the accomodation of skiers and employees of the Applicant and shall include coordination with Countywide transportation systems and facilities. 3. An egress model should be prepared for the Stage II submission. The model should be in sufficient detail to allow Town review of the impact skiers will have on existing egress corridors when Mt. Baldy is at peak capacity. 4. Timing of lift construction may be critical to the success of the ski area and resort. While the Council has concerns regarding timing as it relates to the Stage One S.P.A. plan submission, it is felt that the Stage II submission would be a more appropriate point for discussion of this item. Consequently, the Stage II submission should contain proposed dates for construction of all of the improvements contained in this submission. 5. The Stage II submission shall include documentation of the accommodation of the existing employees of the Snowmass Ski Area. This documentation will provide the basis for a plan, presented as a part of the Stage II submission, to house, whether in Aspen Skiing Company facilities, public facilities or a combination of sources, the employees generated by the proposal. Section Three. Concerns 1. Water availability is always a concern for the Village. Since the proposed Master Plan could require significant amounts of water for snowmaking, the effects of this water consumption should be more carefully studied by the Aspen Skiing Company.
