Town Council Resolution 70 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL BOOK 453 PA6= 5 RESOLUTION NO. 70 SERIES OF 1983 A RESOLUTION AUTHORIZING A RELEASE OF MORTGAGE GIVEN TO SECURE PERFORMANCE OF OBLIGATIONS CONTAINED IN SUBDIVISION IMPROVEMENT AGREEMENTS FOR PARCEL NINE IN THE WOODRUN UNIT FIVE SUBDIVISION. WHEREAS, The Snowmass Company, Ltd. has secured its performance pursuant to a certain Subdivision Improve- ment Agreement and a certain Amended and Substituted Sub- division Improvements Agreement for Parcel 9, Woodrun Unit Five Subdivision; and WHEREAS, the improvements required for Parcel 9 have been completed; and WHEREAS, the Town Council has reviewed the reports of the Town Engineer relating to such improvements and desires to release the mortgage as set forth below; NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One. That the Release of Mortgage, attached hereto and made a part hereof as Exhibit A affecting Parcel 9 of the Woodrun Unit Five Subdivision is hereby approved and the Mayor is authorized to execute same on behalf of the Town. INTRODUCED, READ AND ADOPTED BY THE Town Council of the Town of Snowmass Village, Colorado on the 19th day of September , 1983 by a vote of 6 to 0 Counci 1 member Desmond was absent. TOWN OF SNOWMASS VILLAGE, COLORADO V } Jefferson T ppett, Mayor ATTEST: Susan Garrison, Town Clerk x caCl> co C? xrrn BOOK 453 p, i', tE 9 J RELEASE OF MORTGAGE By that certain Guarantee Mortgage for the Woodrun Unit Five Subdivision Parcel 9 recorded July 8, 1982 in Book 428 at Page 969 of the records of the Clerk and Recorder of Pitkin County, Colorado for the Subdivision Improvements Agreement (Woodrun Five, Parcel 9) recorded July 8, 1982 in Book 428 at Page 958 of said records and by that Amended Guarantee Mortgage for the Woodrun Unit Five Subdivision Parcel 9 recorded September 29, 1982 in Book 433 at Page 302 of said records for the Amended and Substitute Subdivision Improvements Agreement (Woodrun Five, Parcel 9) recorded September 29, 1982 in Book 433 at Page 291 of said records, The Snowmass Company, Ltd. mortgaged certain real property in Pitkin County, Colorado (as described in said Guarantee Mortgages) to the Town of Snowmass Village, to secure the performance of obligations more fully described in said Guarantee Mortgages affecting Parcel 9, Woodrun Unit Five Subdivision. Said Guarantee Mortgages were reduced by that Partial Release of Parcel 9 Guarantee Mortgage recorded June 16 , 1983 in Book A47 at Page 167 of said records. The purpose of such Guarantee Mortgages having been satisfied, the Town of Snowmass Village hereby releases and forever quit claims to the owners of Parcel 9, Woodrun Unit Five Subdivision, their successors and assigns forever, all the right, title and interest which it has by virtue of the above-described Guarantee Mortgages.
