Town Council Resolution 65 1983TOWN OF SNOWMASS VILLAGE -0 TOWN COUNCIL rNJ - .-. ca RESOLUTION NO. 65 �m SERIES OF 1983 A RESOLUTION APPROVING A SUBDIVISION EXEMPTION AND A FINAL PUD AN IILDING PERMIT ONLY) FOR THE SNOWMASS CONFERENCE CENTER. cm M �"cc WHEREAS, the Snowmass Resort Association (Applicant) with the consent of the Snowmass Company, Ltd., as land owner, has submitted an application for Subdivision Exemption in order to authorize the conveyance of a parcel of real property known as the Conference Center site to the Town of Snowmass Village, and an application for approval of a final PUD plan for a project known as the Snowmass Conference Center (not involving subdivision activity) in accordance with the provisions of Section 2.6.7.d(1) of the Land Use Code; and WHEREAS, the Snowmass Village Planning Commission has recommended approval of both the Subdivision Exemption request and the Final PUD Plan as more partic- ularly set forth in Planning Commission Resolutions 13 and 14, Series of 1983; mme WHEREAS, public hearings on both the request for Subdivision Exemption and the Final PUD Plan were held before the Town Council on the 6th day of Septem- ber, 1983, pursuant to published, posted and mailed notice; and WHEREAS, the Town Council has reviewed both applications, has heard and considered the comments of the Applicant, the public and staff and desires to approve both the Subdivision Exemption and the Final PUD Plan hereby. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One. Findings. A. Based upon a review of all evidence submitted at meetings, work sessions and public hearings, the Town Council hereby makes the following findings with regard to the Applicant's request for Subdivi- sion Exemption: 1. That the division of land contemplated in the Application, for the purpose of creating and transferring a parcel of real property to the Town of Snowmass Village as the site of the proposed Snowmass Conference Center is not within the intent and purpose of the Town's Subdivision Regulations, is consistent with the preservation of the goals, objectives and standards of the land area involved, and does not affect in a substantially adverse manner either the enjoyment of land abutting upon or across a street from the property in question or the public interest. B. Based upon a review of all evidence submitted at meetings, work sessions and public hearings, the Town Council hereby makes the following findings with regard to the Final PUD Plan for the Snowmass Conference Center: 35 an 453 PAGE405 1. That no changes have been made to proposed development approved in Stage Two and that no new information has been submitted or discovered which would make the project now inconsistent with the Snowmass Village Master Plan. 2. That the Final PUD Plan is in conformance with the design review evaluation standards contained in the Land Use Code. 3. That the Applicant has complied with the conditions set forth in the Stage Two approval. Section Two. Approval. A. The Applicant's request for a Subdivision Exemption in order to allow the conveyance of the Snowmass Conference Center site itself to the Town, as described above, is hereby approved subject to delivery to the Town Attorney of a Final Plat which accurately describes the Conference Center site and contains the information required by the appropriate provisions of the Land Use Code. B. The Final PUD Plan for the Snowmass Conference Center is hereby approved subject to the following terms and conditions: 1. The Final PUD Plan shall consist of the following elements: a. The Final Land Use Plan approved by Town Council Ordinance No. 12, Series of 1983. b. The plat of the Snowmass Conference Center Subdivision. 2. In accordance with the provisions of Sections 2.6.7.d(2) and (5) and Section 2.6.7.e. the approval of the Final PUD Plan author- izes the Applicant, its successors and assigns to obtain a Building Permit for the structures described in the submission documents and approved hereby upon compliance with applicable regulations governing the issuance of Building Permits and does not authorize the subdivision of the Snowmass Conference Center site itself. 3. That the anticipated gate house to control vehicular traffic on Elbert Lane be located as far from Snowmelt Road as is practical. 4. That all improvements to Elbert Lane contemplated by this appli- cation and the applications for approval of Building L and the Silver Tree expansion shall be undertaken and completed at one time.
