Town Council Resolution 38 1983WHEREAS, the gross parcel plat of the Snowmass Club Subdivision approved by Ordinance No. 8, Series of 1980, contains a dedication of Parcel 7 by the Snowmass Company to the public for open space use; and WHEREAS, at the request of the Snowmass Company and upon approval of the Town Council, the gross parcel plat was amended by the adoption of Ordinance No. 11, Series of 1982; and WHEREAS, said amendment deleted the dedication of Parcel 7 to the public for open space use and substituted therefore a reservation of Parcel 7 for future public dedication for public facilities; and WHEREAS, it was the intention of.the Town Council in approving said amendment to relinquish any ownership interest acquired by the Town by virtue of the dedication language on the original gross parcel plat approved by Ordinance No. 8, Series of 1980, and too, in effect, reconvey said Parcel 7 to the Snowmass Company, Ltd. subject to the provisions of Ordinance No. 8, Series of 1980, as amended by Ordinance No. 11, Series of 1982. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One. In order to facilitate the intent of Ordinance No. 11, Series of 1982, the Quit Claim Deed, attached hereto and made a part hereof by this reference, is hereby approved and the Mayor is authorized to execute same on behalf of the Town. TO HAVE AND TO HOLD the same, together with all and singular the appurte- nances and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title, interest and claim whatsoever of the said party of the first part, either in law or equity, to the only proper use, benefit and behoof of the said party of the second part, its heirs and assigns forever.
