Town Council Resolution 34 1983A RESOLUTION GRANTING A SPECIAL REVIEW USE FOR A WATER TANK TO BE LOCATED ON PROPERTY WITHIN THE SKI EASEMENT ADJACENT TO WOODRUN UNIT I SUBDIVISION (LIFT #7 LOCATION). WHEREAS, the Town Council has reviewed the information contained in the Snowmass Water and Sanitation District's application for Special Review Use of a portion of the Snowmass Company, Ltd.'s property located in the ski easement adjacent to Woodrun Unit I Subdivision (Lift #7 Location), more particularly described by the attached Exhibit A; and WHEREAS, the Snowmass Company, Ltd. has granted permission for submittal of the Special Review use request by the Snowmass Water and Sanitation District for construction of a one million gallon water tank; and WHEREAS, the information contained in the Special Review Use request is consistent with the requirements contained in Section 2.3.3 of the Land Use Code of the Town of Snowmass Village; and WHEREAS, a public hearing on the proposed Special Review Use request was held pursuant to mailed and published notice before the Town Council on the 25th day of April, 1983; and WHEREAS, the Planning Commission has made a recommendation on the Special Review Use request, said recommendation attached hereto as Exhibit B. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One. That the Special Review Use request of the Snowmass Water and Sanitation District is hereby granted subject to the conditions contained in Section Two. Section Two. Conditions. 1. The Construction Management Plan, attached hereto and made a part hereof by this reference, shall be adhered to by the Snowmass Water and Sanitation District and its contractors to the greatest extent possible. 2. All soil reports, addenda and monitoring techniques prepared for the water vessel construction shall be reviewed and approved by the Town Engineer and the Town of Snowmass Village Building Department. r rVt� �. The Snowmass Water and Sanitation District or its contractor shall submit written verification by a qualified soils engineer that the subsurface conditions as encountered and evaluated after tank excavation and prior to actual construction are as anticipated and that the design of the tank foundation system is adequate. Section Three. That this Resolution shall take effect simultaneously with Ordinance No. 10, Series of 1983. WHEREAS, the Planning Commission has reviewed the information contained in the Snowmass Water and Sanitation District's application for Rezoning and Special Review Use of a portion of Snowmass Company, Ltd.'s property located in the easement for the Aspen Skiing Company's Snowmass Lift #7, more particularly described by the attached Exhibit A; and WHEREAS, the Snowmass Company, Ltd. has granted permission for submittal of the Rezoning and Special Review Use request by the Snowmass Water and Sanitation District for construction of a one million gallon water tank; and WHEREAS, the information contained in the Rezoning and Special Review Use request is consistent with the requirements contained in Section 2.3.3 of the Land Use Code of the Town of Snowmass Village. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Town of Snowmass Village, Colorado: Section One. That the Rezoning request of the Water and Sanitation District should be granted. Section Two. That the Special Review Use request of the Snowmass Water, and Sanitation District should be granted subject to the following conditions: 1. The attached construction management plan shall be adhered to as much as is reasonably possible. 2. All soils reports, addenda and monitoring techniques prepared for the water vessel construction shall be reviewed and approved by the Town's Engineer and the Town of Snowmass Village Building Department.
