Town Council Resolution 27 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 27 SERIES OF 1983 A RESOLUTION GRANTING CONCEPTUAL SUBDIVISION APPROVAL, PURSUANT TO TOWN COUNCIL RESOLUTION NO. 79, SERIES OF 1981, FOR THE WILDWOOD INN CONDOMINIUMIZATION. WHEREAS, the Wildwood Inn (the Applicant) has submitted an application for subdivision review pursuant to Resolution No. 79, Series of 1981, on December 21, 1982 and, therefore, has met the submission deadline set forth in Resolution No. 57, Series of 1982; and WHEREAS, the Planning Commission has reviewed the application and has recommended approval with conditions as set forth in Planning Commission Resolution No. 1, Series of 1983; and NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One. That the Town Council hereby grants approval of the ap�ation with the following conditions: 1. The Applicant shall provide, as part of the combined Preliminary and Final Subdivision Review submission data, a report outlining the anticipated fiscal impacts upon the Town and other taxing districts which provide services to the Wildwood Inn. Such report shall be based on criteria and assumptions provided to the Applicant by the Town no later than March 21, 1983. 2. The Applicant shall assure that long range group bookings will be facilitated as much as possible, and shall include provisions in the appropriate condominium documents to assure the following: a. All reservations booked prior to sale of individual units will be binding on purchasers and, in general, any bookings made in advance will be binding in the event of a transfer of ownership. b. Owner occupancy requests will be required at least six months in advance. C. The management company shall have the discretion of utilizing the units for promotional purposes through provision of complimentary rentals. 3. The Applicant shall provide evidence of a commitment to participate in a plan to manage pedestrian and service traffic on Elbert Lane by cash contribution and/or by such other method of cooperation, for development, implementation and operation of such plan as may be approved by the Town Council. 4. The Applicant shall provide evidence of assurance that the six employee housing units currently located in the Wildwood Inn will permanently be restricted to the use of employees only. 5. The Town Council hereby declares, as a matter of policy, that in order to insure consistency with Goal 8 of the Snowmass Village Master Plan an Applicant for development activity, which will generate the need for new employees (persons not currently employed in Snowmass Village), shall participate in the programs undertaken by the Town Council or by the Town of Snowmass Village Housing Authority for the production of comfortable and affordable housing in an appropriate manner and to an appropriate degree depending upon the actual housing demands created by the activity. (This policy is not intended to apply to development activities governed by previous legis- lation imposing specific employee housing requirements). Such participation may take the form of acquisition or production of housing to be made available to employees pursuant to Housing Authority guidelines; commitment to long term leasing by the applicant of Housing Authority projects under terms and conditions which will assist the Housing Authority in financing, construction and/or operating an employee housing project; by cash contributions to the Housing Authority for its use in developing or operating employee housing projects; or by such other methods as may be approved by the Town Council. To that end, the Applicant shall propose the method by which the Applicant intends to participate in Housing Authority programs in the Stage Two Submission. 6. The documents submitted for the Combined Preliminary and Final Subdivision application shall provide that all those elements of the project that are necessary to its operation as a condominium hotel, including but not limited to the conference facility, front desk, lobby, offices, employee housing, utility rooms, storage rooms, laundry rooms, but not including the restaurant, shall be owned by the condominium association or jointly by the owners of the individual units. 7. That the Open Space and Common Area Report to be submitted as part of the Combined Preliminary and Final Submission shall include adequate and explicit owner occupancy limitations to insure the continued operation of the Wildwood Inn as a condominium hotel facility and shall include a statement of the Applicant's commitment to upgrade individual condominium units in conjunction with the sale of such units.
