Town Council Resolution 15 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 15 SERIES OF 1983 A RESOLUTION GRANTING CONDITIONAL APPROVAL FOR THE CONFERENCE CENTER STAGE ONE P.U.D. SUBMISSION. WHEREAS, the Snowmass Resort Association (the Applicant) has submitted an application for approval of a Stage One (Conceptual) P.U.D. Plan for a project known as the "Conference Center"; and WHEREAS, the Town Council and the Planning Commission participated in a joint presentation of this submission by the Applicant on November 29, 1982; and WHEREAS, the Planning Commission submitted its findings and recommendations to the Town Council on the 22nd day of December, 1982, in accordance with the provisions of the Land Use Code as more particularly set forth in Planning Commission Resolution No. 27, Series of 1982; and WHEREAS, the Town Council has reviewed the submission and the findings and recommendations of the Planning Commission and on the basis of such review together with the comments of the public, the Applicant, staff and members of the Planning Commission made in public work sessions, the Town Council desires to approve the Conference Center Stage One P.U.D. Submission subject to the findings and conditions set forth below. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One. Findings 1. Based on the information contained in the record of proceedings in this matter to date, the Town Council finds that the Conference Center Stage One P.U.D. Submission is consistent with the provisions of the Town's current Master Plan and that the land areas contained in this submission are suitable for Planned Unit Development pursuant to the provisions of Section 2.6.5.a.(1) and (8) of the Land Use Code. 2. That the Applicant has complied with the submission data and procedural requirements of the Land Use Code as they relate to Stage One submissions. 3. That the proposed activity will generate the need for new employees who will require comfortable and affordable housing and that, in accordance with the policy objectives of Goal 8 of the Town of Snowmass Village Master Plan, the Applicant should be encouraged to provide housing for such employees within Snowmass Village. Section Two. Conditional Approval Subject to compliance with the conditions set forth below, the amended Conference Center Stage One P.U.D. Submission as described in Exhibit A is hereby approved: 1. The Town Council hereby declares, as a matter of policy that in order to insure consistency with Goal 8 of the Town of Snowmass Village Master Plan, an Applicant for development activity which will generate the need for new employees (persons not currently employed in Snowmass Village) shall participate in the programs undertaken by the Town Council or by the Town of Snowmass Village Housing Authority for the production of comfort- able and affordable housing in an appropriate manner and to an appropriate degree depending upon the actual housing demands created by the activity. (This policy is not intended to apply to development activities governed by previous legislation imposing specific employee housing requirements). Such participation may take the form of acquisition or production of housing to be made available to employees pursuant to Housing Authority guidelines; commitment to long term leasing by the applicant of Housing Authority projects under terms and conditions which will assist the Housing Authority in financing, constructing and/or operating an employee housing project; by cash contributions to the Housing Authority for its use in de- veloping or operating employee housing projects; or by such other methods as may be approved by the Town Council. To that end, the Applicant shall propose the method by which the Applicant intends to participate in Housing Authority programs in the Stage Two Submission. 2. The Applicant shall demonstrate that its best efforts have been employed in the development of energy conservation methods or systems, including solar orientation, of the structure in the proposed submission. 3. The Applicant shall explore a cost sharing arrangement with those properties most directly affected by the need to rebuild the Elbert Lane cul-de-sac and shall provide the details of such arrangement, including design, functionability and financial commitments of each party to the agreement for approval by the Town Council as part of the Stage Two Submission. 4. The Applicant may proceed with the processing of the Conference Center P.U.D., however, no building permit for construction of any portion of the proposed development shall be issued until the Snowmass Water and Sanitation District has had plans for a storage vessel of sufficient size to eliminate the current 500,000 gallon fire flow capacity shortfall approved by the Town Council, until a building permit therefore has been issued and until the Snowmass Water and Sanitation District has committed itself to the construction of the storage vessel by the issuance of bonds or other form of indebtedness to finance the same. 5. The Town shall provide the Applicant with the necessary criteria and assumptions to be utilized by the Applicant in preparing the fiscal analysis required by Section 2.6.6.b.(15) of the Land Use Code no later than February 15, 1983. 6. The Applicant shall provide information in Stage Two dealing with the management of construction activities, with particular attention paid to the storage of equipment and materials, vehicle management and the manage- ment of impacts on Elbert Lane. INTRODUCED, READ AND ADOPTED by the Town Council of the Town of Snowmass Village, Colorado, on the 31st day of January , 1983, by a vote of 6 to 0 Councilmember Bedford abstained from voting on the basis of a conflict of interest as a member of the Snowmass Resort Association's Board of Governors.
