Town Council Resolution 11 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 11 SERIES OF 1983 A RESOLUTION GRANTING CONDITIONAL APPROVAL FOR THE BASE VILLAGE STAGE ONE P.U.D. SUBMISSION. WHEREAS, the Snowmass Company, Ltd. (the Applicant) has submitted an application for approval of a Stage One (Conceptual) P.U.D. Plan for a project known as Base Village; and WHEREAS, the Town Council and the Planning Commission participated in the joint presentation of this submission by the Applicant on November 22, 1982; and WHEREAS, the Planning Commission submitted its findings and recommendations to the Town Council on the 15th day of December, 1982, in accordance with the provisions of the Land Use Code as more particularly set forth in Planning Commission Resolution No. 24, Series of 1982; and WHEREAS, the Applicant has, in response to concerns raised by the Planning Commission and by the Town Council, submitted amendments to certain elements of the Stage One submission, as more particularly described in Exhibit A, attached hereto and made a part hereof by this reference; and WHEREAS, the Town Council has reviewed the initial submission, the findings and recommendations of the Planning Commission and the amendments proposed by the Applicant, and on the basis of such review, together with the comments of the public, the Applicant, staff and members of the Planning Commission made in public work sessions, the Town Council desires to approve the Base Village Stage One P.U.D. Submission subject to the findings and conditions set forth below. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado. Section One. Findings 1. Based on the information contained in the record of proceedings in this matter to date, the Town Council finds that the Base Village Stage One P.U.D. Submission, as amended by the Applicant, is consistent with the provisions of the Town's current Master Plan and that the land areas contained in the Submission are suitable for Planned Unit Development pursuant to the provisions of Section 2.6.5.a.(1) and (8) of the Land Use Code. 2. That the Applicant has complied with the submission data and proced- ural requirements of the Land Use Code as they relate to Stage One Submissions. 11 Section Two. Conditional Approval Subject to compliance with the conditions set forth below, the amended Base Village Stage One P.U.D. Submission as described in Exhibit B, is hereby approved: 1. The Applicant may proceed with the processing of the Base Village P.U.D., however, no building permit for construction of any portion of the proposed development shall be issued until the Snowmass Water and Sanitation District has had plans for a'storage vessel of sufficient size to eliminate the current 500,000 gallon fire flow capacity shortfall approved by the Town Council, until a building permit therefore has been issued and until the Snowmass Water and Sanitation District has committed itself to the construction of the storage vessel by the issuance of bonds or other form of indebtedness to finance the same. 2. The Stage Two Submission shall contain more specific information regarding the Applicant's plans for construction of comfortable and affordable employee housing on the proposed Anderson Ranch parcel of the Snowmass Club P.U.D. and/or other suitable sites in the proper ratio to the number of unrestricted units proposed in Stage Two. Said plans shall include site and financial information in sufficient detail to allow review by the Planning Commission and Town Council to insure that the Stage Two employee housing requirements are being properly addressed. The Applicant shall further explore the addition of on-site employee housing units, primarily for resident managers, as part of the Stage Two Submission. 3. The Stage Two Submission shall contain the following items related to road construction: a. A restudy and resubmission of the Wood Road reconstruction plans with consideration given to the possibility of three laning the road section to at least the point of intersection with the proposed entry into Parcel B. b. A reanalysis of day skier and bus passenger arrival points in order to insure that the proposed design will function given the large number of day skiers, other bus passengers and residents of the Base Village development anticipated. c. Redesign and reconstruction plans for the ski bridge located on Wood Road in the vicinity of Parcel B, if such reconstruction is necessary to accommodate an increased road width or safe pedestrian movement along Wood Road. d. A construction management plan in sufficient detail to describe the Company's plans to mitigate the direct and indirect impacts of construction on and around Wood Road and the extension of Lower Snowmelt Road which pays particular attention to automobile, bus and skier traffic flow, construction traffic and parking and to the needs of residents and visitors in the village, with special emphasis placed on the needs of those residents serviced by Wood Road. 4. As part of the data to fulfill the requirements of Section 1.7 of the Land Use Code, the Applicant shall demonstrate that its best efforts have been employed in the development of energy conservation methods or systems, including solar orientation, of all structures in the proposed Submission. 5. In response to concerns about the negative impacts associated with shading of a significant portion of the lower Snowmelt Road extension, the Applicant shall provide plans or information relating to the mitigation of the shading problem. 6. The Town and the Applicant shall exchange information sufficient to result in an agreement on a site for the relocation of the Town's maintenance facility that will be mutually acceptable and will serve the long and short term maintenance needs of the Town. The Town accepts the offer of the Applicant as described in Exhibit C with the understanding that both the Town and the Applicant shall attempt to resolve the issues relating to the relocation of the maintenance facility prior to Stage Two approval. 7. The Stage Two Submission shall provide sufficient information regarding the Applicant's plans to time share portions of the Base Village develop- ment so that the effects of time sharing on the Town's ability to generate revenue, and on the character of the community can be studied during the review of the Stage Two Submission. Nothing herein shall be construed to waive the Applicant's compliance with the provisions of Ordinance No. 25, Series of 1982, except that the Conceptual Stage submission data require- ments shall be submitted to and reviewed by the Planning Commission and the Town Council as part of the Stage Two review. 8. The number and configuration of parking places is inadequate to serve the development as proposed. Utilizing criteria developed for the Woodrun Place project, the Applicant shall reevaluate the parking plan and submit a new plan for an increased number of parking spaces which includes an increase in on-site parking for employees. The reevaluation and new plan shall be submitted for review in Stage Two. 9. Stage Two shall include an explanation of the Aspen Skiing Company's plans to reconstruct or relocate Lift 1. Such explanation will be satisfied if the Aspen Skiing Company files an S.P.A. which includes its future plans for Lift 1 or Lift 1A as long as the Stage Two submission accommodates those plans. 10. The potential for location of significant commercial space should not be preempted by the Base Village development. Accordingly, a minimum of 25,000 gross square feet of commercial space shall be included within Parcels C and/or D. The Applicant and the Town shall mutually agree upon the types of commercial space uses appropriate for Parcels C and D so that the Land Use Plan to be approved at Stage Two may be written to accommodate a proportionate share of the future (present to anticipated completion date of Parcels C & D) commercial space needs of the West Village area. The Applicant shall make a good faith effort to satisfy the current and future market demand for commercial space at this location in the detailed design of Parcels C and D. 11. The Applicant shall reanalyze pedestrian movement between Base Village and the Snowmass Center, between Base Village and the Mall, and between Base Village and the "Benedict" properties with the goal of insuring that practical pedestrian links between these locations are not preempted. In addition, the Applicant shall prepare a plan which illustrates such linkage at Stage Two. 12. The Applicant shall submit, in Stage Two, an analysis of the feasibility of providing lock -off condominiums in a hotel -like arrangement for Parcels C and D. In addition, the Applicant shall describe plans and/or management techniques, including potential for conference space in each parcel, designed to encourage short term rental of all of the units contemplated in the submission. The inclusion of conference space in Parcels A, B or C shall reduce the conference space requirements of Parcel D. 13. The Town shall provide the Applicant with the necessary criteria and assumptions to be utilized by the Applicant in preparing the fiscal analysis required by Section 2.6.6.b.(15) of the Land Use Code no later than February 15, 1983. The fiscal analysis shall include an analysis of the affects of the proposed phasing schedule on the Town's revenue base. Section Three Additional Studies 1. The Town shall immediately begin a study of the feasibility and advisability of encouraging a service intercept facility as outlined in the Base Village memorandum prepared by the Town's planning staff to be reviewed in conjunction with the Stage Two Submission. 2. The Town shall immediately undertake a study of the long and short term viability and need for lodge units in Snowmass Village to be reviewed in conjunction with the Stage Two Submission. 3 INTRODUCED, READ AND ADOPTED by the Town Council of the Town of Snowmass Village, Colorado on the 17th day of January , 1983 by a vote of 7 to 0 TOWN OF SNOWMASS VILLAGE, COLORADO By: Jefferson ippett, Mayor n EXHIBIT A, THE SNOWMASS COMPANY, LTD. January 11, 1982 Town Council Town of Snowmass Village P.O. Box 5010 Snowmass Village, CO 81615 Dear Council Members: The Snowmass Company, Ltd., in reference to the Base Village P.U.D. Submission would like to confirm the following amend- ments to its submission and agreements with respect to part of the Stage II application: 1. The company proposed 5,375 gross square feet for retail commercial and 2,760 gross square feet for food and beverage commercial space on Parcel D within its submission. The company hereby amends this gross square footage of 8,135 to a range of 20,000 to 30,000 gross square feet of commercial space for retail commercial and food and beverage commercial. This gross square footage of commercial space may be allocated between Parcels C and D within the submission. 2. The Company hereby commits to present a revised plan for the Wood Road improvements in Stage II of the Land Use Code which shall address the concerns raised by the Town Council and Planning Commission discussed in the Stage I approval process. The revised plan shall take into consideration the following points: a. A turning lane from the Wood Road - Brush Creek intersection to Parcels C and D; b. Widening of the ski bridge to provide for better pedestrian movement from Parcel B to Parcel C and D; Town Council January 11, 1982 Page 2 c. A turning lane off of Wood Road into Parcel B. d. A plan for improving a section of Wood Road from the current submission boundary to the Woodrun Unit Five subdivision boundary. 3. The Snowmass Company, Ltd. hereby commits to present within its Stage II submission an architectural/sche- matic plan and configuration for lock -off type condo- minium units on Parcels C and D and management plans to help demonstrate the effect such type of condominium units and the management thereof may have on the short- term rental of these units. 4. The Snowmass Company, Ltd. agrees to include one resident manager's employee housing unit within each Parcel contained within the submission, i.e. within Parcel A, Parcel B, Parcel C and Parcel D. The Snowmass Company, Ltd. reconfirms that the phasing of the development within the submission shall be in the following manner --Parcel A first, Parcel B, second, Parcel C, third and Parcel D fourth. These amendments and agreements to our submission are made as a result of the information received during the Stage I approval process from the Planning Commission, members of the public and the Town Council. Box 5010 Snowmass Village, CO 81615 Dear Council Members: The Snowmass Company, Ltd. would like to take this opportunity to confirm with the Town the company's position relating to an alternate site for the Town of Snowmass Village Maintenance Facility. As you are aware, this question has been brought up in the context of the company's Base Village Submission. The company will be happy to research with the Town and its staff al- ternative sites that would be mutually acceptable for the re -location of the Town's maintenance building. We have requested locational criteria from the Town Planner so that we might be able to assess sites on the company's property to determine for both ourselves and with the Town which site(s) may be acceptable for the maintenance center. Once we have received the locational criteria, we will be glad to work with the Town to determine what sites would be suitable and then make a final determination with the Town. We view this as a joint effort in selecting a site that is acceptable to both the Town and the Company. We would also like to reaffirm our understanding that the company has made commitments to the Town for public lands dedication for community facilities. We will stand by our commitment that the Company would be willing to dedicate a new maintenance facility site to the Town and as part of this dedication recieve credit towards our 36.6 acre agreement for dedication of land for community facilities purposes. The company will work diligently with the Town to find a suitable site and work out the details of timing, size of the site etc. We are willing to make this a priority and hope that the Town will do so as well.
