Town Council Resolution 10 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 10 SERIES OF 1983 A RESOLUTION GRANTING CONDITIONAL APPROVAL FOR THE BUILDING L STAGE ONE P.U.D. SUBMISSION, AS AMENDED. WHEREAS, the Snowmass Company, Ltd. (the Applicant) has submitted an application for approval of a Stage One (Conceptual) P.U.D. Plan for a project known as Building L; and WHEREAS, the Town Council and the Planning Commission participated in the joint presentation of this submission by the Applicant on November 22, 1982; and WHEREAS, the Planning Commission submitted its findings and recommendations to the Town Council on the 15th day of December, 1982, in accordance with the provisions of the Land Use Code as more particularly set forth in Planning Commission Resolution No. 24, Series of 1982; and WHEREAS, the Applicant has, in response to concerns raised by the Planning Commission and by the Town Council, submitted amendments to certain elements of the Stage One submission, as more particularly described in Exhibit A, attached hereto and made a part hereof by this reference; and WHEREAS, the Town Council has reviewed the initial submission, the findings and recommendations of the Planning Commission and the amendments proposed by the Applicant, and on the basis of such review, together with the comments of the public, the Applicant, staff and members of the Planning Commission made in public work sessions, the Town Council desires to approve the Building L Stage One P.U.D. Submission subject to the findings and conditions set forth below. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado. Section One. Findings 1. Based on the information contained in the record of proceedings in this matter to date, the Town Council finds that the Building L Stage One P.U.D. Submission, as amended by the Applicant, is consistent with the provisions of the Town's current Master Plan and that the land areas contained in the Submission are suitable for Planned Unit Development pursuant to the provisions of Section 2.6.5.a.(1) and (8) of the Land Use Code. 2. That the Applicant has complied with the submission data and proced- ural requirements of the Land Use Code as they relate to Stage One Submissions. 1 Section Two. Conditional Approval Subject to compliance with the conditions set forth below, the amended Building L Stage One P.U.D. Submission as described in Exhibit B, is hereby approved: 1. The Applicant shall demonstrate that its best efforts have been employed in the development of energy conservation methods or systems and in the solar orientation of all structures in the proposed submission. 2. The Applicant shall explore a cost sharing arrangements with those properties most directly affected by the need to rebuild the Elbert Lane cul-de-sac and shall provide the details of such an arrangement as part of the Stage Two submission. 3. No building permit for construction of any portion of the proposed development shall be issued until the Snowmass Water and Sanitation District has had plans for a storage vessel of sufficient size to elim- inate the current 500,000 gallon fire flow capacity shortfall approved by the Town, until a building permit therefore has been issued and until the Snowmass Water and Sanitation District has committed itself to the construction of the storage vessel by the issuance of bonds or other form of indebtedness to finance the same. 4. The Town shall provide the Applicant with the necessary criteria and assumptions to be utilized by the Applicant in preparing the fiscal analysis required by Section 2.6.6.b.(15) of the Land Use Code no later than February 15, 1983. 5. The provisions for service access and guest check in are inadequate and shall be reevaluated by the Applicant in Stage Two. The Snowmass Company, Ltd. proposed 28 residential condo- minium units with�i it submission. This number of units will be reduced to 17i; residential units as a maximum number. 2. The Snowmass Company, Ltd. agrees to reduce the height of the building in its Stage 11 application to mitigate as best we can the shadowing of the. Timbernill Deck. The re- duction in height of title building will xesult in a reduction of the proposed gross square footage contained in the building for residential units and will not result in a decrease in the commercial square footage proposed in the building. WHEREAS, the Snowmass Company, Ltd. has submitted a detailed final plat of Parcel 10, Woodrun Unit V Subdivision for review and recommendation by the Plan- ning Commission of the Town of Snowmass Village; pursuant to Resolution #16, Series of 1980; and WHEREAS, the Planning Commission has reviewed the information contained in the submission, heard the presentations of the Town Staff and of the Snowmass Company, Ltd., and has found the submission to be within the maximum limitations imposed by Ordinance #8, Series of 1980. NOW, THEREFORE, BE IT RESOLVED by the°Planning Commission of the Town of Snowmass Village, Colorado: Section One: That approval of the final plat for Woodrun V, Parcel 10 is hereby recommended. Section Two: That while the Planning Commission recommends approval of the final plat, the following concerns should be addressed: A. The mass and scale of the design is not compatible with the pre- sent environment of the general area in which it is situated. B. The Commission wishes to express a concern that no construction management plan has been submitted, and while not required, the Commission recommends that the Snowmass Company, Ltd. submit a plan to coordinate construction activities on and around the proposed Parcel 10 development.
