Town Council Resolution 09 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 9 SERIES OF 1983 A RESOLUTION EXPRESSING THE TOWN COUNCIL'S INTENT TO RESERVE THE RIGHT TO CONSIDER A MORATORIUM ON THE CREATION AND SALE OF TIME SHARE ESTATES. WHEREAS, the Town of Snowmass Village Planning Commission has included a provision in its recommendation relating to an Ordinance regulating the creation and sale of time share estates addressing the subject of a mora- torium; and WHEREAS, the Town Council deems it appropriate to address the subject of a potential moratorium by this Resolution, separately from the Ordinance regulating the creation and sale of time share estates. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado. Section One. That because of the many uncertainties and concerns which have arisen as a result of the Council's evaluation and consideration of legislation regulating the creation and sale of time share estates, which have largely been founded on the experiences of other communities where Time -Sharing has been widely implemented, the Council hereby expresses its intention to consider the imposition of a moratorium on the further review and approval of time share estates once a significant number of time share estates have been approved. The amount of approved time share estates which would trigger the moratorium should be sufficient to constitute a significant enough portion of the tourist accommodations in Snowmass Village to allow the Town to conduct an empirical analysis of the impacts of time shared projects on the community. The impacts to be analyzed should include, but not be limited to, effect on the character of neighborhoods, fiscal impacts, marketing and management techniques employed and maintenance programs utilized. The length of the moratorium should be sufficient to give validity to the analysis with the goal in mind of amending existing legislation or enacting additional legislation to regulate the future creation and sale of time share estates. The decision to implement a moratorium is, of course, dependent upon practical and legal circumstances which may exist at the time it is considered.
