Town Council Resolution 02 1983TOWN OF SNOWMASS VILLAGE TOWN COUNCIL RESOLUTION NO. 2 SERIES OF 1983 A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT FOR A JOINT COMMUNICA- TIONS SYSTEM BETWEEN THE CITY OF ASPEN, THE COUNTY OF PITKIN AND THE TOWN OF SNOWMASS VILLAGE. WHEREAS, there exists a need for a joint communications system serving the City of Aspen, the County of Pitkin and the Town of Snowmass Village; and WHEREAS, by agreement dated February 23, 1976, a Joint Communications Emergency Service Board was created; and WHEREAS, all parties hereto desire to enter into a joint Intergovernmental Agreement regarding the operation and maintenance of a joint communications system for the calendar year of 1983; and WHEREAS, this Intergovernmental Agreement will be subject to an annual review. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Snowmass Village, Colorado: Section One: That the attached Intergovernmental Agreement for a Joint Communications System is hereby approved for the calendar year 1983 and the Mayor is authorized to execute said Agreement on behalf of the Town. CA 88(82) THIS AGREEMENT made by and between the CITY OF ASPEN, COLORADO (hereinafter referred to as "City") and TOWN OF SNOWMASS VILLAGE, COLORADO (hereinafter referred to as "Town") and the BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO (hereinafter referred to as "county"). WITNESSETH : WHEREAS, there exists a need for a joint cozmnmications system serving the City, the Town and the County, and WHEREAS, by agreement dated February 23, 1976, a Joint Commmi.ca- tions and Emergency Services Board was created, and WHEREAS, all the parties hereto desire to enter into a Joint intergovernmental agreernent regarding the operation and maintenance of a joint comrnmi_cations system for the calendar year 1983 which the agreement is intended by the parties to replace and supercede the joint agreement originally made February 23, 1976, establishing a Joint Communisations and Emergency Services Board, and all agreements, amendnents and additions thereto. NOW, THEREFORE, TfiE CITY, TOWN AND COUNTY AGREE AS FOLLOWS: 1. It is hereby agreed and understood that this agreement shall replace and supercede the joint agreement originally made on February 23, 1976, establishing a Joint Coim nications and Emergency Services Board, together with all subsequent agreements, amendments and additions pertaining thereto. 2. The parties hereto agree to operate and maintain a ;joint communications system to service each of the parties. The operation and maintenance of the system shall be governed by a Joint Comrnmications and Services Board (hereinafter called the "Board") which shall be composed of the following individuals: a. City Manager of the City of Aspen; b. County Manager of the County of Pitkin; c. Sheriff of Pitkin County or, should the County so designate, the Undersheriff of the County of Pitkin; d. The City of Aspen Police Chief, or should the City designate, the Deputy Police Chief of the City of Aspen; e. The Town of Snowmass Village Marshal or a law enforcement officer designated by the Town. 3. It is agreed and understood by the parties that the Board shall have the following duties, responsibilities and powers regarding the operation and maintenance of'the joint comnrn mications system: a. The establishment of policy for the supply of efficient communications services to all of the parties hereto on an equal basis. b. The authority to employ and discharge the Director of the joint conum ications system, who must be a law enforcement officer in the State of Colorado. c. Review the performance and operation of the comrnmications center and make such recommendations to the parties concerning the efficient performance of the comzmrdcations center. d. Provide policy guidance and direction to the Director of the joint comications center as the Board deems necessary and appropriate. e. Arbitrate and decide all operational disagreements between the Director, the law enforcement agencies of the respective parties and/or other use agencies. f. Establish guidelines and providing connunica.tions center radio services to all appropriate public service agencies as is feasible and appropriate. g. The Board shall meet quarterly and at such times as requested by either the Director of the joint comrnnnications system or a Board member. 4. The parties agree and understand that the joint comrnnications system will function and operate through a communications center. The operation of the communications center shall be supervised by the Director, who shall have the following authority, duties and responsibilities: a. Responsibility for the day to day operations and long range planning of the comrnmciations center as directed and within the policy guidelines established by the Board. b. Employ and discharge all commmications center personnel. c. Prepare and recommend to the Board an annual operating budget which shall set forth the percentage of operating costs attributable to the City, County and Town;. 5. It is agreed and understood between the parties that the communications center shall perform the following communications, computer services, record keeping and miscellaneous functions: a. Communications: 1. Receive calls from the public on the emergency and dispatch phone lines and those transferred by all user agencies for emergency service. 2. Dispatch such calls to the appropriate agency personnel. 3. Provide requested Colorado Crime Information Center ("CCIC") and National Crime Information Center ("NCIC") computer and file information to law enforcement personnel in accordance with the CCIC user agreement annexed hereto as Exhibit "A". b. Computer Services: 1. Enter, receive and disseminate all CCIC and National Crime Information Center ("NCIC") information as requested by law enforcement personnel only. 2. Comply with the terms of the CCIC user agreement, annexed hereto as Exhibit "A". c. Records Keeping: 1. House, file and maintain all records and reports for the City of Aspen Police Department and the County of Pitkin Sheriff's Department, provided, however, that all jail and booking records shall be maintained by the agency housing the jail facility (i.e. the County of Pitkin Sheriff's Office). 2. Combine the Town's information into the master index cards per copies of reports supplied. 3. Issue monthly S.T.E.P. and U.C.R. su -aries and other statistical reports as requested by user agencies. d. Miscellaneous Functions: 1. Answer law enforcement agency user phones as requested from 5:00 P.M. to 8:00 A.M. weekdays and from 5:00 P.M. on Friday to 8:00 A.M. on Nbnday on phone lines into the communications center provided by the respective agency. 2. Handle walk-in traffic for the Aspen Police Department from 5:00 P.M. to 8:00 A.M. weekdays and from 5:00 P.M. Friday to 8:00 A.M. Ibnday. 3. Provide lost and found services for all the parties hereto, including logging in all lost and found property and cross- indexing the same against stolen property records; provided, however; that each law enforcement agency will _house, maintain and dispose of all 6f,its respective lost and found property. 7. This agreement shall become effective on the date of the signatures of all parties hereto and shall be renewed on an annual basis as provided in Section 12. 8. It is hereby agreed and understood between the parties that any party hereto may terminate this agreement by six (6) wnths' written notice to the other parties, and it is agreed that such termination will not affect the rights and interests acquired by the respective parties during the term of this agreement if such interest has, in fact, been acquired. If reimbursement is to be made, it shall be based on services performed and work completed to date. It is the further understanding of the parties that if and when said termination occurs, the City, County and Town shall split owned capital equipment, if any, on an equitable basis according; to the financial contribution of each. 9. The 1983 budget for the Joint Communications Center Department shall be: Revenue: City of Aspen (44.) $ 95,750. Pitkin County (44b/o) 95,750. Town of Snowmass (lZ1.) 26,114. TOTAL $217,614 Expenditures: Advertising $ 300 Telephone 9,000 Utilities (Red Mtn.) 500 Maintenance contract (Motorola) 2,961 Maintenance - Repeaters (Dady) 1,000 Maintenance - Dictaphone 1,200 Maintenance - IBM 240 Maintenance - BOSS (copier) 325 Gen'l Liability Insurance (Aspen) 1,600 Property Damage Ins. Any budget changes, in the form of additions, deletions or other shall be reviewed by the ComrnnZications Board and forwarded on to the governing bodies of each party for confirmation. No party shall be liable for over expenditures made by another party unless these expenditures are formally agreed to by the governing bodies of each party. 11. Any revenue or grant income which might be received as a direct result of the Conmunica.tions Center Department shall be shared by all three parties to this agreement on a pro rata basis in accordance with their share of the annual operating costs. 12. It is the understanding of the parties that this agreement may be renewed on an annual basis with appropriate budget preparations included for each successive year. This budget shall be approved by the Com unications Center Board and forwarded on to the governing bodies of all parties to this agreement for their approval. 13. The financial administration for this agreement shall be provided by the City at no charge to either the County or the Town. 14. The County and the Town shall, on a monthly basis, contribute 1/12 their annual budget amount ($ 95,750.- County and $ 26,114 - Town), to the City. 15. A final accounting of all revenues and expenditures for the program for the prior year shall be completed by March 15 of the subsequent year, with final payment adjustments between the parties to be made on or before that date.
