Town Council Ordinance 13 2010TOWN OF SNOWMASS VILLAGE TOWN COUNCIL ORDINANCE NO. 13 SERIES OF 2010 AN ORDINANCE TO AMEND CHAPTER 18 OF THE TOWN OF SNOWMASS VILLAGE MUNICIPAL CODE TO REQUIRE CLASS A ROOF ASSEMBLIES ON ALL NEW CONSTRUCTION AND RE -ROOFS GREATER THAN 50% OF THE EXISTING ROOF AREA REGARDLESS OF OCCUPANCY TYPE OR TYPE OF CONSTRUCTION. WHEREAS, the Town of Snowmass Village has the authority to implement regulations for new and existing construction within the limits of the Town, and WHEREAS, wood roofs are one of the most significant factors in the ignitability of homes. The ignitability of homes is an important factor in the spread of wildfires to other homes, and WHEREAS, wood roofing is problematic during fires and can cause ember throw for more than a quarter mile. When wood shake roofs burn they can send large burning embers well behind established fire lines, and WHEREAS, replacement of wood roofs is an important factor in reducing the potential for catastrophic fires that result in loss of life and millions of dollars of property loss, and WHEREAS, the Building Code Board of Appeals of Snowmass Village has reviewed, mudifiad, nnrn��� 'he ha crcac� nt iii44� ha iii�Qjad - WHEREAS, the Town Council finds that the adoption of this Ordinance is necessary for the immediate preservation of the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF SNOWMASS VILLAGE, as follows: Section One: Amendments to Chapter 18. The provisions of Chapter 18 of the Municipal Code are hereby amended and restated as follows: Article III Building Code Section 18-42 Amendments (q) Delete entire sub -section and add as follows: 10-13 Ordinance Page 2 of 4 TABLE 1505.1 MINIMUM ROOF COVERING CLASSIFICATION FOR TYPES OF CONSTRUCTION (Delete footnotes a, b, c) 1505.3 Class B roof assemblies. (Delete in its entirety) 1505.4 Class C roof assemblies. (Delete in its entirety) 1505.5 Non classified roofing. (Delete in its entirety) 1505.6 Fire -retardant -treated wood shingles and shakes. (Delete in its entirety) 1505.7 Special purpose roofs. (Delete in its entirety) 1507.8 Wood shingles. (Delete in its entirety) 1507.9 Wood shakes. (Delete in its entirety) 1510.4.1 Reapplication of wood shakes or shingles. In all occupancy groups, reapplication of wood shakes or shingles over existing underlayment, in good condition, shall be done with a minimum -Class A roof covering. Exception 1: The occasional replacement of individual shakes or shingles Exception 2: For existing roofs; a one-time exemption is allowed to replace up to 50% of the existing roof covering to match existing roof. This one-time exemption runs with the life of the property and not the owner. If more than 50% of the roof is to be replaced, the new roof shall conform to this Section. All structures regulated by this code shall have a Class A roof covering as required by this section to be listed and tested in accordance with UL 790 or ASTM E 108. Class A roof assemblies include those with coverings of brick, masonry, ferrous or copper shingles or sheets, metal sheets and shingles, clay or concrete roof tile, or slate installed on noncombustible decks. (NEW) R902.2 Exemptions from Class A roofing requirements. The following applications are exempt from the Class A roofing requirements contained herein: 1. Greenhouses, patio covers, temporary fabric membrane structures, residential car covers and awnings. 2. Repair or replacement of up to 100 square feet of existing roof covering, per structure. 3. For existing roofs; a one-time exemption is allowed to replace up to 50% of the existing roof covering, per structure to match existing roof. This one-time exemption runs with the life of the property and not the owner. If more than 50% of the roof is to be replaced, the new roof shall conform to this Section. R905.7 Wood shingles. (Delete in its entirety) R905.8 Wood shakes. (Delete in its entirety) Section Two: Effective Date. This Ordinance shall become effective on July 31, 2011. Section Three: Severability. If any provision of this Ordinance or application hereof to any person or circumstance is held invalid, the invalidity shall not affect any other provision or application of this Ordinance which can be given effect without the invalid provision or application, and, to this end, the provisions of this Ordinance are severable. READ, APPROVED AND ADOPTED, by the Town Council of the Town of Snowmass Village at First Reading on August 16, 2010 upon a motion by Council Member Mordkin, the second of Council Member Butler, and upon a vote of 4 in favor and 0 opposed. Council Member Wilkinson was absent.
