CALL TO ORDER AND ROLL CALL Mayor Pro Tem Sirkus called to order the Regular Meeting of the Snowmass Village Town Council on Monday, June 6, 2016 at 5:05 p.m. Mayor Pro Tem Sirkus stated that Mayor Butler requested that the Town Council go through the agenda and addressing the Joint Planning Commission meeting last so she may attend. Sirkus apologized to the Planning Commission for having to sit through the Town Council Meeting. A complete live recording of this meeting can be found at www.tosv.com under Town Council Meetings. This will be archived indefinitely allowing you to view at any time. COUNCIL MEMBERS Bill Madsen, Tom Goode, and Bob Sirkus. PRESENT: COUNCIL MEMBERS ABSENT: Alyssa Shenk absent and Markey Butler arrived late STAFF PRESENT: PUBLIC PRESENT:Janice Vos Caudill, Richard Goodwin and other members of the public interested in today's Agenda items. 2. PROCLAMATIONS AND PRESENTATIONS Update on Primary and General Election for 2016 --Janice Vos. Pitkin County Clerk and Recorder Janice Vos Caudill, Pitkin County Clerk and Recorder stated that the Clerk's office has moved and she provided the new address forthe Clerk's office to the old Ute City Building and the new location for the vehicle registration is downstairs in the vectra Bank Building. Vos then provided information for the public and the Town Council regarding the upcoming Primary Election which is June 28, 2016 and the General Election which is November 8, 2016. she stated the ballots were mailed today Clint Kinney, Town Manager, John Dresser, Town Attorney, Julie Ann Woods, Community Development Director, Anne Martens, Public Works Director, Rhonda B. Coxon, Town Clerk. for the Primary. She noted that both elections are mail-ballot. Rhonda Coxon, Town Clerk has information on the voting times and places. 4. PUBLIC COMMENT This section is set aside for the Town Council to LISTEN to comments by the public regarding items that do not otherwise appear on this agenda, Generally, the Town Council will not discuss the issue and will not take an official action under thrs section of the agenda. Richard Goodwin a resident of Snowmass Village and owner of a unit in Capitol Peak building in Base Village. He read a statement that he prepared and read at a Base Village Owners meetings. He is asking that the members of the Master Association be removed as soon as possible or he is going to sue the current members of the Base Village Association. John Dresser, Town Attorney responded to Goodwin's request and stated the Metro District was form and it is a separate government and a Special District, the Town of Snowmass Village has no authority for this request. Town ol Snowmass has no jurisdiction to remove the officers of Base Village Master Association. A. DRAFT AGENDAS AND WORK SESSION TOPICS B. APPROVAL OF MINUTES 1) December 7,2015 - Regular Meeting 2) May 16, 2016 - Regular Meeting Mayor Pro Tem Sirkus asked some questions regarding the Ballot language for the school district and he would like the opporlunity to discuss the ballot language before it is approved. Clint Kinney, Town Manager stated that the ballot language should be ready to review at the July sth, 2016 Regular Town Council Meeting. Bill Madsen made the motion to approve those items listed on today's consent agenda. Bob sirkus seconded the motion. CONSENT AGENDA These are items where all conditions or requiremenls have been agreed to or met prior to the time they come before the Council for final action. A Single Public Hearing will be opened for all items on the Consent Agenda. These items will be approved by a single motion of the Council. The Mayor will ask if there is anyone present who has objection to such procedure as to certain items. Members of the Council may also ask that an item be removed from the consent section and fully discussed. All items not removed from the consent section will then be approved. A member of the Council may vote no on specitic items without asking that they be removed from the consenl section lor full discussion. HESOLUTION NO, 24, SERIES OF 2016 _ A RESOLUTION AUTHORIZING THE ENTRANCE INTO AN INTERGOVERNI\,IENTAL AGREEMENT BETWEEN THE TOWN OF SNOWMASS VILLAGE AND THE SNOWMASS WILDCAT FIRE PFIOTECTION DISTBICT ESTABLISHING A LAND USE REVIEW PROCESS FOR A PROPOSAL TO REPLACE THE EXISTING SNOWMASS WILDCAT FIRE PROTECTION DISTRICT FIRE STATION LOCATED IN THE TOWN OF SNOWMASS VILLAGE --John Dresser, Town Attorney John Dresser, Town Attorney spoke to the lntergovernmental Agreement with Snowmass Wildcat Fire Protection District is a Special District and they do not have to follow our municipal zoning. This IGA set's a streamline schedule for a review process. He noted that the Fire District has already signed this lGA. This would be a two-step process one meeting in front of the Planning Commission and then to the Town Council. Tom Goode made lhe motion to approve Resolution No. 24, Series of 20'16 an IGA between the Snowmass Wildcat Fire Protection district and the Town ol Snowmass Village establishing a modified land use review process. Bill Madsen seconded the motion. The motion was approve by a vote of 3 in favor to 0 opposed Council l\.4ember Shenk and l\.4ayor Butler were absent. Voting Aye: Bill Madsen, Tom Goode, and Bob Sirkus Voting Nay: None INT I,4EETIN WITH THE PLANNI MIVIISSION Town Council and Planning will now meet jointly in order for Planning Commission to present the "State of the Comprehensive Plan" to the Town Council At this time the Chairman Jamie Knowlton called to order the Joint l\ileeting between the Town Council and the Planning Commission and the Town Clerk, Rhonda Coxon took roll at this time. PLANNING COMIVISSIONERS PRESENT: Doug Faurer, Jim Gustafson, James Knowlton, Thomas Fridstein, Teri Hooper, Jim Anathan 0 opposed. Council Member Shenk was absenl, Mayor Butler had not arrived. Voting Aye: Bill Madsen, Tom Goode and Bob Sirkus Voting Nay: None. 8, ADI\,,1IN ISTRATIVE REPOFTS 06-06-16 TC l\,1inules Page 4 of 5 PLANNINGCON/NiIISSIONEFABSENT: PatrickKeelty Julie Anne Woods, Community Developmenl Director stated Staff is prepared to solicit consultants through an BFP process to assist with the Comprehensive Plan Update and community engagement. lt is expected that interviews and selection of a consultant (or consulting team) will be made by a team of Statf, Town Council and Planning Commission members in mid- to late July with a consultant coming on board in early to mid-August. Staff strongly recommends that a Steering Committee comprised of the Planning Commission, Town Council, and community members be established that will serve as the primary advisory group during this process. Once a consultant is on-board and the Steering Committee is lormed, one of the first tasks will be to help ref ine the plan update process and provide an extensive calendar of public engagement activities so that feedback on vision and policies can be gathered Irom as many residents, second homeowners, and visitors as possible. The Planning Director will serve as the Projecl Manager with assistance lrom lhe Planner and Senior Planner, but it is expected that each Town Department and other service providers (Fire, Water & San., HOA, etc.) will be asked to serve on a technical advisory committee. Our goal is to complete the Comprehensive Plan Update with adoption by Town Council in 2017. Town Council has allocated $200,000 Ior the update to the Comprehensive Plan in 2016. Process of the consultants to keep from getting a generic plan, rural nalural character, fairly broad with what is put out there, selection on qualifications not on price and flexibility. Encouraged staff to refrain from a packaged process but something that can make systems unique to Snowmass Village. Tom Goode made the motion to approve the Planning Commission's Besolution No. 6, Series of 2016 and to set the Public Hearing date for the "State of the Comprehensive Plan" June 20th, 20'16. Bill Madsen seconded the motion. The motion was approved by vote of 3 in favor to 0 opposed. Council Member Shenk and Mayor Butler were absent. Voting Aye: Bill Madsen, Tom Goode, and Bob Sirkus Voting Nay: None. At this time the Planning Commission adjourned their meeting with a motion by Jim Gustafson, seconded by Tom Fridstein. The motion was approve by a vote of 6 in favor and 0 opposed. Planning Commissioner Keelty was absent. Council took a break at this time 6, PUBLIC HEARINGS None at this time. 7. POLICY/LEGISLATIVE PUBLIC HEARINGS No Hearings Scheduled 9, TOWN COUNCIL REPORTS AND ACTIONS A. REPORTS/UPDATES Council Member Goode has C.O.R.E. meeting on Tuesday, June 7th. Council Member Madsen toured the Land Fill with the Snowmass Village Rotary and found it very interesting and finally understands the single stream process. He encourages people to take a tour. Council Member Sirkus spoke of the two species of mussels and two invasive plants at Ruedi and the steps being taken to prevent the spread of these species to other waters into the reservoir. Mayor Butler arrived at this time At this time the Council asked staff about the status of Ordinance No. 9, Series of 2015 and the agreements. John Dresser, Town Attorney stated that staff is reviewing the agreements for compliance. 10. ADJOURNMENT Bill Madsen made the motion to adjourn the Regular Meeting of the Snowmass Village Town Council on Monday, June 6, 2016 seconded by Markey Butler. The motion was approved by a vote of 4 in favor to 0 opposed. Council Member Shenk was absent. Voting Aye: Bill Madsen, Tom Goode, Bob Sirkus and Markey Butler Voting Nay: None.
