CALL TO ORDER AND ROLL CALL Mayor Pro Tem Sirkus called to order the Regular Meeting of the Snowmass Village Town Council on Tuesday, September 6, 2016 at 4:04 p.m. A complete live recording and/or audio of this meeting can be found at www.tosv.com under Town Council Meetings. COUNCIL MEMBERS PRESENT: COUNCIL MEMBERS ABSENT: Bob Sirkus, Bill Madsen, Alyssa Shenk, Tom Goode, and Markey Butler who arrived at 4:15 pm. All council members were present STAFF PRESENT Clint Kinney, Town Manager, John Dresser, Town Attorney; Rhonda B. Coxon, Town Clerk; Anne Martens, Public Works Director; Andy Worline, Parks and Recreation Director; Brian Passenti, Aquatic's Manager; Sarah McMahon, Rec Program Manager and Jocelyn Ritti, Rec Center Manager; Starr Jamison, Park and Trails Manager PUBLIC PRESENT Jeff Kremer, Darryl Grob, Nancy Shapario, Sarah Oates and other members of the public interested in today's Agenda items. 2. PROCLAMATIONS AND PRESENTATIONS None at this time 3. PUBLIC COMMENT This section is set aside for the Town Council to LISTEN to comments by the public regarding items that do not otheruvise appear on this agenda. Generally, the Town Council will not discuss the issue and will not take an offrcial action under this section of the agenda. None at this time 4. CONSENT AGENDA These are items where all condrtions or requirements have been agreed to or met prior to the time they come before the Council for final action. A 09-06-16 TC Min utes Page 2 of 5 Single Public Hearing will be opened for all items on the Consent Agenda, These items will be approved by a single motion of the Council. The Mayor will ask if there is anyone present who has objection to such procedure as to certain items_ Members ol the Council may also ask that an item be removed from the consent section and fully discussed. All items not removed from the consent section will then be approved. A member of the Council may vote no on specific items without asking that they be removed from the consent section for full discussion. Any item that is removed from the consent agenda will be placed on the regular agenda. A. DRAFT AGENDAS AND WORK SESSION TOPICS B. RESOLUTION NO. 29, SERIES OF 2016 - A RESOLUTION APPOINTING MEMBERS TO FILL VACANCIES ON THE SNOWMASS ARTS ADVISORY BOARD (SAAB)- DARLENE FRIDSTEIN AND STEPHANIE PARMELEE -Rhonda B. Coxon, Town Clerk C. RESOLUTION NO. 31, SERIES OF 2016 . A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF SNOWMASS VILLAGE AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT WITH PITKIN COUNTY FOR THE INSTALLATION, USE, AND MAINTENANCE OF A DIGITAL TRUNK RADIO SITE AT THE SNOWMASS VILLAGE TOWN HALL -Anne Martens, Public Works Director D. RESOLUTION NO. 30, SERIES OF 2016. A RESOLUTION FINDING THE PETITION OF LOIS B. POPE REVOCABLE TRUST DATED MARCH 29, 2OO7, REQUESTING ANNEXATION OF CERTAIN REAL PROPERTY INTO THE TOWN OF SNOWMASS VILLAGE TO BE IN SUBSTANTIAL COMPLIANCE WITH THE PROVISIONS OF THE MUNICIPAL ANNEXATION ACT OF 1965, SETTING A DATE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION: AND RATIFICAT|ON OF A PRE- ANNEXATION AGREEMENT -- John Dresser, Town Attorney Alyssa Shenk made the motion to approve those ilems listed on today's consent agenda. Tom Goode seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. At this time Council Member Madsen asked that Resolution No. 30, Series of 2016 be pulled from the Consent agenda for discussion. He had issues with square footage. John Dresser, Town Attorney explained the annexation process. This is only cerlifying the petition and if it meets the statutory statutes. Mayor Butler arrived at 4:1 5 p.m. 09-06-16 TC Minutes Page 3 of 5 Council Member Goode had a question regarding Resolution No. 31, Series of 2016 and inquired about the changes and building permits and inspections for this project. Voting Aye: Bob Sirkus, Bill Madsen, Alyssa Shenk, Tom Goode, and Markey Butler. Voting Nay: None. 5.P UBLIC HEARINGS QUASI.JUDICIAL HEARINGS Public Hearings are the formal opportunity for the Town Council to LISTEN to the public regarding the issue at hand. For land use hearings the Council is required to act in a quasi-judicial capacity. When acting as a quasi-judicial body, the Council is acting in much the same capacity as a judge would act in a court of law. Under these circumstances, the judicial or quasi-judicial must limit its consideration to malters which are placed inlo evidence and are part of the public record. The Council must base their decision on the law and the evidence presented at the hearing. None at this time. 6. POLICY/LEGISLATIVE PUBLIC HEARINGS No Hearings Scheduled 7. ADMINISTRATIVE REPORTS A. POSTR - Consultant Presentation --Andy Worline, Recreation, Parks and Trails Director Andy Worline, Recreation, Parks and Trails Director, introduced Drew Pollack-Bruce from SE Group and he began the presentation of the Draft POSTR PIan. Pollack-Bruce stated that the primary goal of this POSTR is to be a long-range planning and implementation document to guide the future development of parks, open space, recreation and trails system within the Town. He noted that the Town will be able to administer resources and understand the community's priorities when acquiring park and open space parcels, creating new indoor and outdoor recreation amenities, new trails, preserving and improving existing indoor and outdoor facilities. This Master Plan will act as a roadmap to enable the Parks, Recreation & Trails Department to continue its mission lo: "provide safe, expertly managed recreation programs and facilities that promote community cohesion, physical fitness, as well as family and individual well- being". Pollack- Bruce then reviewed the entire Public engagement process and reviewed the mission statement and reviewed all the goals for each area of the plan. Member of the Steering Committee that were present at the meeting introduced themselves. Council Member Sirkus spoke to his concerns with the RETT fund and the fees and the cost recovery. 8. TOWN COUNCIL REPORTS AND ACTIONS 09-06-16 TC Minutes Page 4 of 5 A) REPORTS/UPDATES Clint Kinney, Town Manager asked when the Town Council would like to discuss the Employee Survey Results. Town Council consensus was to make the Work Session on October 10, 2016 a Special Meeting to discuss the Employee Survey and an Executive Session for the Town Manager Review. They also discussed the Budget Meeting for Thursday, October 6th from 9:00 a.m. to 1:00 p.m. Council Member Shenk reported that she was on a NWCOG telephone meeting for six hours and reported that the Director is leaving and they will be looking for a replacement. Council Member Madsen spoke to the wonderful weekend for the Jazz Aspen Snowmass and there were a lot of people in attendance on Sunday. Mayor Butler stated she and Clint Kinney, Town Manager attended a CAST meeting and she reviewed some of the items that were discussed. She also echoed Council Member Madsen in regards to the Jazz Aspen Snowmass weekend. She also noted she will be attending a RFTA meeting. Council Member Sirkus spoke to the RAWAPI meeting and he is looking fonivard to the results of the inspection program for the Aquatic Nuisance Species Project. He also stated that the funding has ended for this project. Council Member Goode thanked the TOSV road crew for getting the road open so quickly and efficiently after the Jazz Aspen Snowmass Labor Day Festival. 9. EXECUTIVE SESSION At 6:30 p.m. Bob Slrkus made the motion to enter closed session. Tom Goode seconded the motion. The motion was approved by a vote of 5 in favor to 0 opposed. Voting Aye: Bob Sirkus, Bill Madsen, Alyssa Shenk, Tom Goode, and Markey Butler. Voting Nay: None. Town council will now meet in Executive session pursuant to c.R.s. 24-6-402(4) and snowmass Village Municipal code section z-as@), to specifically discuss one item: a) Personnel matters, except if the employee who is the subject of the session has requested an open meeting, pursuant to C.R.S. 2a-6_ao2(a)(f)(l) and Snowmass Village Municipal Code Section 2-45(cX6); 09-06-16 TC Minutes Page 5 of 5 Provided, there is an affirmative vote of two{hirds of the quorum present at this meeting to hold an Executive Session and for the sole purpose of considering item (a) above. Provided further, that no adoption of any proposed policy, position, resolution, regulation, or formal action shall occur at this Executive Session. At 7:41 p.m. Alyssa Shenk made the motion to reconvene to the Regular Meeting of the Snowmass Village Town Council on Tuesday, September 6, 2016. Bob Sirkus seconded the molion. The motion was approved by a vote of 5 in lavor to 0 opposed. Voting Aye: Bob Sirkus, Bill Madsen, Alyssa Shenk, Tom Goode, and Markey Butler.
